I currently have orders that are just "pending" and not yet official. If I have my Leading Petty Officer write a letter for expedite, will this still be grounds to expedite my K1?

Actually, my supervisor told me they wont send me on these orders with my current requests through immigration....which is pretty nice of them.

However, they really want me to go on these orders and are willing to write a letter asking for my petition to be expedited.

Do you think such a request in writing will be approved???

I would definitely try. I've never encountered this myself, but Ive read on here about others with military orders being expedited very easily. But if youre not going to be sent, it's really not fair to jump ahead of the line. We all have to wait and jumping ahead puts someone else behind. My fiance and I waited 150 days for our NAO2 and that was without any problems occurring along the way.

Chris, I couldn't agree more with you. I dont want to push others behind at all. However, the Navy really wants me to go on these orders, but they are being very understanding about my situation with my fiance.

They want me to go on these orders, but they are willing to not send me to better cater to me.

They do however want to try to expedite things so that my fiance can be here and I can deploy. They want her to have my life insurance benefits and medical benefits.

I'm not trying to jump in line at all, honestly. But if they want me to deploy, I will ask for expedite on those grounds.

I believe that, yes, you do qualify under hardship or expedite criteria. I think you are also off the hook with the 125% of the poverty line income requirement (only need 100% for military, methinks). Ill see if I can find the links for you.

ETA: Here's the link about expedite criteria : http://www.uscis.gov/portal/site/uscis/men...0000ecd190aRCRD

I think what made me think of this was that I am constantly asked if I am inquiring on an expedite request based on military employment or some such stuff whenever I call USCIS.

And I coudnt find the documentation on the I-134 (which is where I thought it was supposed to be), but it is on the I-864 that you only need meet 100% of the poverty line to sponsor if you are on active duty.

I would get that letter signed by an officer and not an NCO. I had my letter signed by an O-4.

It's kind of unusual that the military will cater to your personal life when it comes to deployments, but if they will, then I need to cross over into the Navy. :P

When I asked for expedite I wasn't even attached to a team to deploy, but it was highly likely that I would be. (And I was, as I am currently in Iraq)

After I faxed my expedite package, I was approved within 2 days.

Hope this helps,

Matt

good luck to you i hope you get your expedite. as far as jumping the line, um it's not like you are somebody who is just impatient. as someone who is serving our country in a time of war you deserve to have your case examined sooner than the rest of us. (just my humble opininon)

I would certainly hope that our military earns above the poverty level. Is this really an issue?

Calling an illegal alien an "undocumented immigrant" is like calling a drug dealer an "unlicensedregistered pharmacist". (because somebody gives a damn)

It was when I joined the service in 1975, but I think the pay has improved much since then.
