guys,

please advice which is better for india K3 or CR-1 ??

i sen in i-130 with the wrong fees i know its going to be rejected ..... if i decided k-3 i will dent both at the same time (i-129 and i-130)

if CR-1 --- just i-130 with the correct amount

i know about the $1010 i have to pay for K-3 in adjustment status .... and i believe i have to pay $380 for CR-1 i-184 fee as well .

at this point i care about my wife being here than the money

please advice

Hi, I went through and am still going through the exact same thing. I also have a friend who is gong through this at the early stages and advised him as I am about to describe to you.

The advantage of K3 over the 130 alone is time. There is debate about which is faster, but I don't believe what anyone has said about it one way or the other. I have seen that 130 or K3 get processed in very similar time. However, if you go with CR1 instead of K3, you will spend an additional two months. I say four because the NVC processing for CR1 will end up taking close to two months. Then when your CR1 case is ready to be sent to Consulate (New Delhi?), the New Delhi Consulate will schedule an interview about two months (44-60 days) from the date your DS-230 is entered in their system. With all the shortcuts, you might be able to cut out one month. Whereas with K3, the main bottleneck is the transfer of your case from USCIS to NVC. As soon as K3 gets to NVC, it is sent via email and then courier to New Delhi. So for example, if K3 approved 7/25, arrives at NVC 8/10, then 8/11 New Delhi has your case, and that day or day after they should have in their system. As soon as they confirm they have your case no. you can submit DS230 and the earlier you get DS230 submitted, the earlier interview date you get. In my mind, I weighed the value of about $700 to 2 months, and to the hassles my wife would have to deal with. I made the hassles first priority (I wanted it as simple on her as possible) and next having her here with me. The additional $700 ranked third. Although the paperwork, additional cost, and time to get to AOS interview is a pain in the ###, it is one I accept because she will be here in two weeks as opposed to what would have been almost two months later.

My point is that you have to weigh what is more important to you. Prioritize and know the pros and cons of each method. Then make your decision accordingly. Given the current onslaught of petitions though, I suspect time is going to be even more precious a commodity than it already is.

From my experience.. i would say CR is the better option. searching the timelines I have seen that people who just do CR get an approval faster, compared to people who file for both I-130 and I-129f. in the end with K-3 you end up saving maybe a month or 2...but sometimes even not that. if you are able to make a trip to visit your spouse in India..then stick with CR.

I have an important question: It would be nice when you can help me with my problems.

My wife applied I-129F and I-130. unfortunately, we send the I-129F to the wrong address in CA instead of Chicago.

And we are very frustrated.

But there is no problem with I-130 and we waiting 4 month for that . The question, should we refile I 129F again, or not?

and if my I-130 is approved, can I come to the US, or should I wait more for the other process ????

Is the process for I-130 more then 6 months?

have you received a letter from uscis (NOA1) for your I-129F? if you have then you are fine... otherwise i don't know. email some of the senior members here with your concern. i am sure they will have some answers for you.

The 6 month timeframe is only for USCISs part of the process, it can be shorter but it's all in the luck of the draw (CSC seems to be dragging applications out to their limit, while VSC are approving at least a month or so faster). On top of that, you have processing time at the National Visa Centre (I believe a couple of weeks for I129F and up to a couple of months for I130) and also time taken for the embassy to process your file and schedule an interview. For the UK it is about 10 months from start to receiving the visa and this is one of the faster embassy's. I'm sure that processing time will lengthen due to all the delays we're seeing at the CSC :(

You might want to check the Australian forum to see roughly how long it takes the embassy to schedule interviews.

Actually, my wife will go to San Francisco to ask about my I129f-case. If they say that we must transfer the case from California to Chicago, then we have lost 4 months. we pray that we have an answer from Immigration for I-130 soon. We applied it since June (4 month).

Today, I called the US-Embassy for B2-Visa. And they said that I have 50% chance to get a tourist-visa, because I applied for the immigration to the US.

Actually, I like to visit my wife only for two weeks, not more. Where is the problem? Anyway, I will try it next week.

we are very sad that the US-Embassy won't understand how difficult and hard is for us that we must wait a long time for our process.

Today, I called the US-Embassy for B2-Visa. And they said that I have 50% chance to get a tourist-visa, because I applied for the immigration to the US.

Actually, I like to visit my wife only for two weeks, not more. Where is the problem? Anyway, I will try it next week.

If you are from Australia, why don´t you come to the US on the Visa Waiver Program?

It is difficult to get a B2 Visa AFTER applying for K3 or CR1/IR1, but it is not difficult to travel to the US using VWP.

I understand your frustration. Most of us are feeling it, as we wait for the process to end.

You should talk through your reasons for deciding to move to the US and think of how things would be if the move was in the other direction. After all, every couple on here has had to decide which country they eventually want to reside in.

Our decision to move to the US was based on the quality of life that we would have in the US vs the same in the UK. That, coupled with the fact Josh has a very supportive family network which I don't have here, made the decision quite easy. We would never be well off in either location but we would be happier in Iowa than in Berkshire.

If we decided that he would come to the UK, we would be together within only a few weeks. And, as the process goes on, it becomes more and more appealing to change direction BUT we are thinking about our future past the time this process ends. The brightside is that this process is just making us stronger as a couple.

Too late to edit my email... just adding:-

If the VWP is available to Australia you can travel to the US even while waiting for the K3/CR1. I did that in September from the UK and had no issues. I had my whole folder of evidence with me in case I was asked for anything and I have to admit to being very nervous waiting for the trip to arrive (it's no fun thinking you could get there and then be turned back).

All you have to be prepared for is to prove ties to home should you be asked for them. This might be a letter from employer stating you're in permanent employment and the date you are returning to work, proof of owning a home, return ticket etc etc. The burden of proof is on you to prove to them that you have no intentions of staying. I presume the same type of proof would have to be shown at the embassy should you wish to continue with the B2 visa application. One thing to mention though... I believe I'm right in thinking that even having the B2 visa does not guarantee entry. The final decision is made by the officer at the point of entry.

Hello Amoro,

I think you should be ok. If your wife said you received the NOA1 for the I-129F, then you are ok. I filed to the Chicago address and a couple of weeks later in was transferred to CA. The procedure now states that you must file your I-129F to the Service Center where you file your I-130 and not to Chicago.

You should have your wife give USCIS a call or track the status of your case on line (with your receipt number).

Amoro, the status of my case reads the same "This case is now pending at the office to which it was transferred.", so this is normal...I got this message when my case was transferred to California Service Center. But like I said before, try giving USCIS a call to double check that everything is OK.

we called the USCIS two times and my wife was in San Francisco. They can't help us to send our I-129F to Chicago. I call the USCIS every day. when I give my case number, the machine says my case is in Laguna Niguel. I can't understand why they won't work.

Calling dose not work at all :-(

what do you think; is it better that I forget the I-129F and only wait for the I-130????? my I-130 is over four and half months.

dose I-130 depend on the I-129F?
