In my divorce case (Texas), we had an open court ruling by the judge. I was definately divorced at that point, no doubt about it. Yes, I had to wait several more months for the actuall decree to be completed and signed by the judge, but I was legally divorced regardless. If you had an open court ruling what about obtaining a certified copy of the court transcript? Not sure if this would be sufficient but it may be worth looking into.

The court transcripts is not enough to prove you are free to marry I got an RFE from Vermont because I sent the Ruling of Divorce. or court transcripts this was even after my 120 waiting period was over the RFE said that they need the Certificate of Absolute Divorce which in MA would'nt be issued until the 90-120 day waiting period is over.

That really sucks. It seems a court transcript should be acceptable. I'm sorry they now have to wait so long to get the final papers.

I'm not advocating this, but I wonder if it might make sense for the OP to go ahead and file with what she's got, and then wait for the RFE. The problem with this is, of course, that the documentation clearly states that the divorce must be final at the time of your petition. So at worst it might result in not only your check being cashed, but an outright denial.

An RFE in this case would potentially be a disaster... If you could not provide additional documentation to cure the question that they were "free to marry" on the date the petition was filed would result in a denial.

An RFE in this case about this particular question to me would be a very bad thing

Yeah, the more I think about it, the worse the idea sounds. So...never mind. :)

But then again we all need to keep in mind that each state handles divorces in different ways. Waiting times during legal sep. and appeal times after the signature of a judge vary. I would check with the clerk of courts for the appropriate legal papers and wait times. Better safe than sorry.

August 14 VSC Received

August 21st touched

August 22nd touched

August 23rd touched (cleared security checks)

September 14th 2007 NOA2

September 20th 2007 Hard Copy of NOA2

September 20th 2007 Letter drawn up from NVC

with new case number. Within a week

Visa petition will be sent to London.

September 29th 2007 letter received from London Embassy

*they have it :D* Need to schedule Medical.

October 12th 2007 Medical complete and done....passed :D

November 5th 2007 Checklist sent to London Embassy

November 12th 2007 Checklist received by London Embassy

You can only submit the petition of you are legally able to marry. Wait until the divorce is final and you had the documents from the court with the court stamp
