I've been reading up what happens next in our journey to the states and I read that packet 3 will include

a) DS-230 Part 1

B) I-864

I am organising getting the I-864 filled out by my spouse and her father who will be co sponsoring me but I can't find the DS-230. Is this available so that I can start getting a jump on the paperwork?

14/8/07 - Police confirmed receipt

20/8/07 - Posted I-130 to London

25/8/07 - I-130 Returned asking for copy of Andrea's student visa and more proof that we live in the UK !!!

25/8/07 - Posted I-130 Back to Embassy In London (1st class recorded delivery) with copy of Student Visa and copy of Council Tax Bill

29/8/07 - Received E-mail (assume it is NOA1) confirming filing date of 29th Aug 2007 - YAY :)

30/8/07 - Money debited from our Credit Card

01/09/07 - The waiting begins :)

14/9/07 - Police Records Returned

1/11/07 - A company that interviewed me has offered the services of an immigration lawyer

7/11/07 - Immigration lawyer files my DS-230 and Notice of Readiness

8/11/07 - Embassy requests further information proving a viable marriage (if anybody hasn't yet filed their I-130, I would advise that you send the following with the I-130.

1) A affidavit from the petitioner detailing their relationship, how it started, developed, etc, etc

2) An affidavit from three people who know you both

3) Past emails, flight bookings, Pics, Dinner receipts, phone bills, etc, etc

12/11/07 - Send all the above back to Lawyer in London

26/11/07 - Lawyer got a case number and I have booked my Medical, I-130 STILL Not Approved

26/11/07 - Got the official offer letter from the US based company - YAY

27/11/07 - It official, the idiots at the USCIS have lost the RFE parcel - grrrrrrr

28/11/07 - RFE resubmitted

3/12/07 - I-130 APPROVED (NOA2)

4/12/07 - Medical

13/12/07 - Interview - APPROVED :)

29/12/07 - Arrived in Philli

Timeline

Two BIG warnings about the I-864:

  • Domicile is an absolute requirement for the I-864, and you MUST provide an I-864 for an Immigrant CR-1 visa. So yes it is crucial that you show that you maintained domicile, or are in the process of re-establishing domicile.
  • IRS returns must be filed by the US citizen even when living abroad, the US citizen may be exempt from paying tax on foreign income, but is not exempt from filing an annual IRS return.

BOTH are requirements for the US citizen to be able to file the I-864. (This tends to be something that hangs many DCF petitioners)

Thanks, my wife (USC) has just received her tax transcripts and has US banks accounts/Credit Cards open and active. The only problem I worry about is that the tax returns were filled in her maiden name AND she filled the last return as Single and not Married, not sure if they will pick up on that or if it will matter, views ???

The only problem I worry about is that the tax returns were filled in her maiden name AND she filled the last return as Single and not Married, not sure if they will pick up on that or if it will matter, views ???

You were married before 31 December 2006, right? Then yes, it is a problem that she filed as single. The maiden part isn't a problem at all though. I would have her contact the IRS part of the US embassy in London and get advice on how to amend her 2006 return to reflect her married status.

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

Speaking of filing single. I think I messed up on mine. Maybe I filled in the wrong form? I filled out the 1040EZ. That's what I've always done so I, without thinking, filled out that one. But I've gone back and looked and I don't think that was the right now.

Does anyone know what we should fill out if we are living outside of the US and are married and made $0?

8-15-2007 Toronto received I-130

8-27-2007 Toronto called to set up I-130 appointment

8-31-2007 Interview at Consulate Approved

9-25-2007 Received Packet 3 in mail

12-9-2007 Received police record (fingerprint version)

1-18-2008 Sent packet 3 back

2-26-2008 heard back from Montreal via email about our interview date

4-23-2008 Montreal Interview!!! Visa APPROVED!!

5-31-2008 Crossed the border into the US to live! :) (one of the happiest days!!)

Currently residing in NC and loving it!

03/2011 Looking into getting dh US citizenship (and just when I thought we were done with all the paperwork! Ha!

If your income was really $0 from all sources, you are not required to file. This is not a question of living in the US or abroad, but a question of minimum filing requirements for all US citizens.

From Publication 54 of the IRS, Tax Guide for U.S. Citizens and Resident Aliens Abroad at www.irs.gov/publications/p54/ch01.html#d0e466 :

Filing Requirements

If you are a U.S. citizen or resident alien, the rules for filing income, estate, and gift tax returns and for paying estimated tax are generally the same whether you are in the United States or abroad.

Your income, filing status, and age generally determine whether you must file an income tax return. Generally, you must file a return for 2006 if your gross income from worldwide sources is at least the amount shown for your filing status in the following table.

Sep 11, 2007 ...... sent I-130 to Rome Embassy (USCIS District Office)

Oct 4, 2007 ........ received letter, I-130 approved and forwarded to Consulate in Naples

Oct 25, 2007 ....... received packet 3 by e-mail

Feb 1 2008 ....... got called for March interview but asked to postpone because not yet ready to move
