20 year old daughter I-130/I-485 from VWP timeline

Hi, all,

I just wanted to give an update on David's daughter's AOS journey from when the I-130/I-485/I-765 were submitted in case it helps someone.

She arrived in the US in January 2007 on the VWP and decided not to return to England. She had obtained a K-2 visa in August 2004 (with David's K1 and Chris' K-2) but decided to remain in England the day before they were supposed to come to the US. (Boyfriend :bonk:). She had come for a visit on the VWP in October 2005 and stayed for around 2 weeks.

I don't have room to add it to my signature and there isn't any way to add her info to my timeline so the complete info is below:

6-18-07 I-130/I-485/I-765 mailed to Chicago lockbox.

6-20-07 Received

6-26-07 NOA1s received for all

6-27-07 Checks cashed

6-28-07 Bios notice; bios 7-24 for I-485/I-765

7-24-07 Bios completed

7-25-07 I-130/I-485 transferred to CSC

8-03-07 online status: I-130/I-485 transferred & now pending standard processing

8-08-07 I-485 touched

8-10-07 I-485 touched

8-16-07 I-485 touched

8-17-07 email notification: RFE mailed

8-19-07 I-485 touched

8-24-07 Received RFE; want court documents for citation received (there were none)

8-29-07 Mailed additional info regarding citation with letter from Town attorney stating no charges filed, etc

9-04-07 CSC received RFE

9-05-07 Email notification I-765; card production ordered

9-10-07 EAD received

9-11-07 Email from CSC; RFE received, processing resumed

Congrats on the approvals.

I was not aware that what you did was even a possibility. I guess even after all these years dealing with immigration, there's still things I don't know!!!! :)

Did the fact that your husband's daughter had once obtained a K-2 Visa have any bearing on her being able to adjust from the VWP? I thought only people who came to the U.S. on the VWP, and then married a U.S. citizen, could adjust status afterwards without having to leave.

Dec. 4/07... I-751 sent to NSC

May 23/08... 10-Yr. PR Card arrives in the mail

Mar. 22/11.... N-400 sent to AZ

June 27/11..... Interview - PASSED!!!

July 12/11..... Oath Ceremony

No, her previous K-2 never had any bearing on it. I just wanted to to mention as many facts about her situation as I could think of.

Her case was transferred to the CSC and didn't have an interview. I know that not many come across situations like hers and I wasn't sure how to handle it at the time either. When I was reading the I-130/I-485 though it didn't sound as if there would be any problems and there weren't, thankfully (except for the RFE to straighten out).

It seems to depend on whether a visa number is immediately available or not and since we married before she turned 18 I could petition for her as the stepmother/daughter.

Thanks, all, I appreciate the good wishes. :) The last thing I wanted was to begin more immigration processes at the time but thankfully for her part it's over for awhile!

They even included a nifty little green card envelope to protect it :lol: I'd rather they skip that and just save the $
