Can husband visit for christmas after we have started the paperwork?

We put in the I-130 on Sept 06, my husband is wanting to come over for 2 weeks at christmas, would he be able to fly over on a visa waiver and stay 2 weeks and then return to England afterwards or would they not let him through customs? Would this end up being a problem with immigration when he does get his interview? Everytime he has flown over in the past it has been on the visa waiver, and even after we were married i flew to England in July on the visa waiver to see him, I just dont know if it is allowed now that we have started the paperwork on him for us to continue to visit one another.

What we can't guarantee is that he'll be let in.

He can definitely fly here, though.

As long as he can prove that he isn't planning on staying this time, there shouldn't be a problem.

It's anybody's guess if he will be allowed in, but many have done so successfully. If at all possible, he can fly through Dublin (and Shannon, I think) so if he is refused entry at least he will have less distance to return!

It is allowed, but there is no guarantee he will be able to enter the U.S.

It is completely at the discretion of the officer that he will get at the time. To increase his chances, he should take with him as much evidence that he intends to return to his home country after his visit to the U.S., such as lease/mortgage documents, a letter from his employer stating the date he is expected back at work, his most recent pay stub, etc.

Many people have successfully visited their spouse/fiance with no problems.

Hi! My husband came over and stayed here for a while. He went back before the waiver date was up. There was no problem in either direction. He just said he was on holiday in the states. No problem. I guess it depends on the officer. Argh I hope ours is done by Christmas, haha we can't afford more plane tickets at the moment. GOOD LUCK, you should be fine!

I dont think they'll give him a tourist visa while you already have an application for a spouse visa... they might think you're trying to cheat your way in... right?

I tried to get a visa to go meet my husband's family before we got married, they denied it because I was working as a contractor, so I didn't have any solid bonds in Brasil, so frustrating...

At the time, I waited 2 months for an interview and when the day came I stood in line for 4 hours just to talk to someone at the embassy and then they turned me down. I promised Chris that I would never make myself go through that again. Who do these people think they are?

He doesn't need a tourist visa.....he's from England. They can come over on the visa waiver program.

My wife (Mags) is from the UK, and she came over on the visa waiver while our K1 visa was in processing.

I've just returned from a trip to see my hubby. As others have said, take proof of ties to home so that if he is asked, he can show it. It seems most people don't even get asked to show the evidence, I certainly didn't.

My case might be a bit different though, because my primary reason for having this visit was to attend my brother-in-laws wedding. I answered "family wedding" as being the reason for the trip so my husband was never mentioned. It might have been a more thorough questioning if my husband did come up in the questioning.

I went to USA last November.

I was denied entry as a intended imigrant without a visa.

If ur partner comes. Make sure he can prove he has strong ties to his homeland.

Also if they ask him any questions be truthful.

As if they interogate him, and he lies.

The ###### will hit the fan, if they find out the truth.
