K3 visa

Hello

I tried to do DCF in Costa Rica but it's not going to happen because of the resideny requirement. I'm over it!! and moving on.

Anyway I have been documenting evidence and paperwork sine early may ( so muuuuuch of it). I was married on July 23, 2007 and I have a lot of pictures and evidence of a relationship and the actual wedding and honeymoon, but we are just starting and I still dont have legal residency in Costa Rica, how do I prove that we are actaully trying to live together?

I have evidence that we are renting together in CR, and a joint bank account, notarized letters of witnesses at our wedding, pending marriage certificate (certified letter from the civil registry saying that the document is in process)

Can anyone shed some light on this situation?

Ahhh I almost forgot, How can I organize my petition before sending the thing? Since the process is so slow you dont want to make them have to actually look for anything, because they probably won't anyway, Right?

The best thing to do is read this --> Step-by-Step Guide on How to File for a K-3 Visa for your Foreign Spouse

Follow each step carefully and when in doubt.... read it again.. :thumbs:

I know there is an overwelming amount of things to do when you file without using a lawyer but VJ has a fantastic amount of knowledge assembled here so read the guides and search the forums.

The step by step K3 is great.

I also read that if your i 130 is approved before the 129F you could just go with the i 130 instead. Is this true? Will it take longer then?

The best thing to do is when you do your cover letter, list everything in order and make two copies of your packet

Theoretically, yes, but if you don't "clearly indicate on the I-130 that you desire Consular processing, they will hold the I-130 and you will be stuck with the K3.

Facts are cheap...knowing how to use them is precious...

Pushbrk, our I-130 has been approved, but they will send out an RFE for the I-129F. We didn´t indicate on the I-130 that we desire consular processing.

Is there any way to do it now?

Or do we have to wait until the I-129F will be approved?

When your I130 was approved, did it say on the NOA2 that you received in the snail mail that they were sending your case to NVC or something to the effect that you indicated that your spouse is in the US and will apply for AOS. If its the latter, you will be waiting for the K3.

You can file an I824 to get your I130 moving on to NVC and the consulate, but that takes time to process and costs $200. You would probably have the RFE, respond to it, and have an approved 129F through NVC before the I824 is processed.

It depends on what your NOA2 says.

When your I130 was approved, did it say on the NOA2 that you received in the snail mail that they were sending your case to NVC or something to the effect that you indicated that your spouse is in the US and will apply for AOS. If its the latter, you will be waiting for the K3.

Yes, it is acceptable. I've seen no clear instructions from USCIS on how but I would put it in the cover letter and write in big red letters on the I-130 "Consular Processing Please"
