VJers,

Does a minor child need a Colombian Passport in order to receive a K-4 VISA? She is listed on both the I-130 and I-129f forms that I submitted. It seems that I read somewhere on here that the child receives "derivative status" and when the beneficiary (mother) is granted a VISA, the child automatically qualifies too.

I need some input so I can have my wife start the process to get a Passport for her daughter...IF it is needed. Advise Please!!

Thanks,

Craig,

Yes her daughter will need a passport as well. My step son also needed a passport and i orig. thought he didn't and that the visa for him would be stamped in the mothers passport, I was totally wrong as my wife investigated this further with the passport agency as well as the notary office. The good news is the Colombian passports are very cheap(less than 150mil pesos) and done the same day.

Met in Medellin Colombia October 06

Was in Medellin 1 week every month for the the year

Married June 28th 07 Wedding in Bello ( applied for residence in Colombia, granted temporal residencia for 2 years.)

04/23/08 Called again

You've already been told yes but I want to add a small clarification for future readers. It country of origin doesn't make any difference. If you're traveling to the US and not a US Citizen, you need a valid passport from your country of citizenship, regardless of age. For this visa process the visa is not a "stamp". It is a paper form glued to and filling an entire page of the passport and it contains the visa holder's picture. No passport, no visa.

Just to add additional clariication.. Some countries (USA does not do this) will allow minor children to "ride" or be included on the parents passport. This child(ren) MUST be listed in the parental passport. The USA however, reccomends that all people who enter the USA have there own passport but accepts either at the POE. In situations where you have a "rider" BOTH visas are put in the parental passport.

YMMV

Good clarification. My comments were intended to apply to "for this visa process", meaning marriage based, K, CR, IR etc. I don't know if other visa categories get a paper visa glued to a full page. Maybe some do but aren't the kind a child would be granted.

This certainly applies to K-2/K-4.
