Can't afford the filing fee for I-751

Hello,

This is my first post here, although I have lurked for a while now.

My husband and I are getting ready to send off our packet for the I-751 petition to remove the conditions on my PRC.

I have read that the fees have recently been increased to $465 (+ $80 for biometrics.)

I'll cut to the chase - we can't afford to pay this fee and make our rent for the month.

I've read on the USCIS website that a fee waiver for the I-751 is available but so far, I cannot find a form to download and fill in nor any instructions on how to go about doing this.

I would be most grateful if anyone can suggest anything helpful.

UK female + US male

Came to USA to work in summer 2002, met and fell in love with US citizen.

02-03 Commenced long distance relationship!

December 2003; filed K1 papers in London

Apparoval and received: K1 Visa: 8th March 2004

I've never heard that there is a fee waiver for the I-751. The new I-360 has no fee but you have to be abused.

there doesn't appear to be a form, it's an affidavit you include with your application. you risk the application being returned if the fee waiver is denied.

Pay for play, re-evaluate your budget otherwise you could end up being out of status.

Do you not have room on a credit card to pay it? Or someone who can loan you the money? It's really really important to get it done. I am sure that the fee is only waived in very extreme circumstances.

You need to help us by putting some info in your timeline or signature. When does your or your husband's green card expire? If you are at the beginning of the 90-day window preceding expiration, I would put away $180 a month for each of the next three months and then file at the last possible moment. Plenty of people file at the last moment; there's no downside unless you need the NOA1 right away to travel (which I doubt you or your husband will be doing owing to your financial circumstances).

If even $180 a month is too much, or you have already waited until the last minute to file, you will have to weigh the options of (1) the success of a fee waiver (remote, I would say, but I am not completely sure) vs. (2) going out of status until you have enough money to file.

I would never suggest going out of status, but it's apparently been done, I believe as long as there was an explanation as to the delay in filing. That's info you'll have to dig up here yourself, though.

February 19, 2010 - Card Production Ordered. Status now IR1

It would be highly unlikely for you to get a fee wavier, I know someone here in boston who applied for the fee wavier to remove their conditions.... it was denied, the reason they were given was that you were aware that you would need to file this and when, you therefore had plenty of time to budget for the money... I would try to gather the money over the next 90 days and file on the last day if you need to... the person I know who was denied re-filed late and included a letter explaining the denial of fee wavier and the fact they then needed to gather the money together.... they were approved without further insident...

The above legal aid site pretty much covers all you need to know about applying for a fee waiver. Make sure you include all the financial information that they request.

If they don't grant you a fee waiver, they will simply reject your application due to not having the correct fee and send everything back to you.

At least, they could plea that the fee was recently increased and they didn't know about it until they wanted to file. Still, a waived fee sounds improbable: the applicant passed the poverty test to get their Green Card. A waiver should be granted only, if also the sponsor cannot pay due to unforeseeable circumstances.

Sending the application while applying for a waiver might have a delaying effect: They could start saving until the first application is denied and then apply with the fee added. But I don't know if this strategy would work - ask a legal immigration center about it first (I assume that you cannot afford an attorney).
