Hi, I am new to VJ. I have recently been engaged. My fiance is from China. I am a single mom, not alot of money, and have been a full-time student in college. I am wondering how that will affect the K-1 process. Wil it go against me that I have been a fulltime student for 3 years, and not working, though I am looking for employment again now?

I know this may seem as a stupid quwstion, I am confused as to try to go for the K-1, or the K-3 in about 6 months, after I graduate from college.

For K-1 or K-3, you as the US Citizen will be the petitioner and sponsor of your foreign fiance, you'll have to meet the income requirement that will vary depending on the size of your household, so if you are not working right now, that might be a problem, but there's an option to have a co-sponsor.

Well you can go for a so called Co-Sponsor with the Visa.

I would read some info here on VJ about K1 and K3,it will help you make your mind up on what you want.

That's all a judgment call. Usually I advise people to determine their priorities and decide first whether to marry in the US or abroad. Then deal with the visa path that fits that choice.

If you have adequate employment or sponsorship by the time the affidavit of support must be submitted, either path will work well for you. Your separation will be far shorter if you go ahead and file the I-129F now instead of waiting until after you marry in China but that doesn't mean it's the best choice in your circumstance. Only you can determine that.
