AOS interview

This might be a silly question but how long should you have to wait for an AOS interview? I know you can chase up an I-765 after 90 days but is there an equivalent deadline for the I-485?

Basically, you can call for information if you have passed the anticipated processing date that is listed on the NOA receipt. When my file was transferred to California last October the receipt said that the expected processing time was between 270 to 300 days, so that means until 300 days has passed I am not able to make an inquiry. After 300 days have passed - sometime in August - I can find out what is going on, so no it isn't forever you have to wait - it just seems like it.

The good news is that we are quickly approaching our 2nd anniversary in June so maybe we will skip the 2 year conditional GC and go directly to the 10 year. Good luck for a speedy processing of your application, but don't be surprised if you must practise a lot of patience in the meantime.

I would think it would depend on how the beneficiary arrived here, what type of visa. My wife came here on a K-1 and she had 90 days to marry or return to her homeland. It is my assumption that you should file for AOS after marriage but don't let it run too long. I have seen others post that they went a few weeks past the I-94 expiration and didn't have any problems. If this is a concern I would recommend you seek legal assistance.

It probably has much to do with the length of the delay. If you can prove that your RFEs (if any) were received, you sent a complete package and whatnot, then you're probably in a situation that allows you to seek a complaint, especially if your processing date is earlier than the one listed for your district office.

Talk to a congressperson/senator if things get very hairy, or make InfoPass appointments.
