Hi everyone, I hope you’re all doing well.

 

I’m in a very confusing situation and would really appreciate any advice or insight.

 

We are living in the Middle East, and because of the war and the embassy shutdown, we asked the NVC if it would be possible to transfer our immigrant visa interview from Jordan to the U.S. Embassy in London. We explained that my spouse only has a tourist visa for the UK. The NVC accepted the transfer and scheduled the interview in London.

 

Since then, we have been trying to contact the London embassy to confirm whether they will actually process the case, since my spouse does not have permanent status in the UK and only holds a tourist visa. Their response has been that this decision will only be made at the interview and will depend on the consular officer.

 

This puts us in a very difficult position. We would need to travel to London, complete the medical exam there, and spend a lot of money without knowing whether the case will even be processed.

 

Has anyone been in a similar situation, or does anyone know what we can do? If the embassy in Jordan is still closed for immigrant visa processing, is it even possible to transfer the case back there? Right now, we feel stuck in a very uncertain situation.

They mean the visa decision will be made after the interview.....London is going to interview the applicant and "process" the case.  I assume you have a London DOS case number.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

That is how I read it, I have not come across a Consulate accepting a transfer and then there being that issue where all the facts are known.

Knowing how the London Embassy operates, they’ll likely put in Administrative Processing until they verify all his documents including your marriage certificate if you married in the Middle East even if they accept the transfer.

Are you sure it's worth it given she can't get an immigrant visa at the moment anyway? Or does she have another citizenship she can use?

 

I'm reading it the same way everybody else is, i.e. London has accepted the case but they're just saying the interviewing officer will make the decision on the visa. But I'm not sure I'd be spending all that money on travelling to London if she'll then be refused and unable to get a visa for months/years anyway. I think I'd be waiting until the ban is lifted and then seeing if Jordan is an option for interviewing if so, to save travelling all that way.

It'll definitely be put in to AP - Jordan is on the list of banned countries, so she can't get a visa right now.
