Hi VJ,

 

Our ROC (mine & 3 kids) are filed and being process, when is the right time to apply for citizenship? My ROC was filed earlier this year and has been pending ever since and when its possible is it all four (4) of us will file?  Any details are appreciated, thank you.

Kids cannot apply based on marriage. They have to wait for 5 years if they are over 18. If under, they will become citizens once you naturalize

Kids are all under 18, age 9,10,12. 

So i need to wait for my I-751 to get approve and file?

No, you absolutely don't need to wait for I-751 approval.

 

3 years after "Residence since" date you can file N-400 even if I-751 is still pending. Sometimes you can file 90 day early, that is if you lived with spouse as married for 3+ years on early filing date.

 

I'd include all I-751 receipts and write a cover letter so officer knows your situation.

 

N-600 for each kid is highly recommended after kids become citizens. It is more expensive than N-400, but they won't have an option for N-400 unless you remain LPR until they reach 18. N-600 is ultimate proof of their citizenship. Doesn't have to be filed immidiately. Let me know if you want to learn more.

Since you entered on a K1 (based on your timeline), AOS'd and received your GC, you should qualify to file in the 90 day early filing period (roughly a year after you filed the I751, consult the early filing calculator).  There are a lot of opinions as to should one wait to file the N400 until the I751 is complete.  My opinion, and the path my wife followed, is that if US citizenship is a goal, there is no need to wait, file the N400 when you meet all the filing requirements.  As @OldUser already outlined, your children will obtain citizenship through you, you can apply for a US passport for them using your naturalization certificate

Ive been a stay-at-home mom/wife since I arrive and I still don't have a license (im 4'9 ft and been practicing our Suburban and its overwhelming sometimes) would that be a problem if I file my N-400 without a license & income? I'm still working getting my license tho😬

Having a DL is not a requirement to file the N400, but if you don't have a State ID, I would apply for that at least.  Btw, my wife hadn't driven when she came over, but like you, she practiced, and eventually she got her DL.  Enjoy practicing with a Suburban!

Agreeing with @Dashinka

At leadt get state ID so you have proof of address. It's a good document to have in general.
