What about filing taxes after AOS?

Timeline

My husband moved over in April and since he wasn't legal or didn't have a SSN, I had to check a different box then married on my taxes. So at the moment, I'm still just claiming single and 0. Hopefully by the time its tax season, he'll be legal, so will I be able to claim him and say married.. which means getting more back or what?

April 21 Dave arrives in America!

April 28 WE GET MARRIED!!!

May 9 Went to SS office and was denied

May 15 After gathering all paperwork, told we must file through DORA program

July 19 DORA appointment - they send paperwork to Chicago after this.

July 24 Paperwork is received by Chicago

August 9 Notice for Biometrics appointment

August 28 NOAs for AOS/EAD

Sept 6 Biometrics

Sept 26 Email saying card production ordered for EAD.. YES!!!

Oct 9 EAD card, Yay!!!!!

Dec 31 Finally got the Resident card! Yay!!!

Your profile shows that your husband came on K-1, why are you saying he wasn't legal??

You got married this year, right? So you wwere single in 2006? You did the right thing by checking the "Single" box then.

Even if he doesn't have his SSN and green card by the next tax season, you will need to file as "married" and request an ITIN number for him when filing your taxes. here's the IRS link for you on ITIN's, what they're for and how to apply for them:

Most likely you'll be getting more money back when filing as "married".

You do!! My husband changed his status to married at work, and he saw a $62 increase per paycheque!! It was sure nice to start having that extra money in our account! If you don't change it with your employer, I am sure you'll just end up getting it back with your tax return at the end of the year, but I prefer to have the money now to help out with expenses, especially because we're on one income!

My wife arrived in dec 2006, we got her a ssn right away, married by the 28th of dec 2006. When I filed my taxes it was married/jointly. Even though we were only married for 3 days of 2006 the tax code only stipulates that you had to be married within that calendar year.

SSN arent that hard to get, my wife had hers in a couple of weeks, it just said she couldnt work but no biggie she couldnt anyway.

A piece of personal advice on requesting ITINs: file the request for ITIN paperwork now!

My husband and I were married in October 2006. I found out about ITINs fairly late in the tax season this year, so I sent in my tax return attached to his ITIN request form... this was in early March. Once his ITIN had been designated, they would file my return for me, and I was told it would only take about 6 weeks from start to finish and I would receive the ITIN by mail. Well, as you can guess, it took MONTHS. I think I just got my federal return in like July. Besides that, I had filed my state taxes on time too but the state said they had to put it in hold until I had the ITIN, so once June hit, I started calling the IRS helpline every few days to ask if the ITIN had been processed yet. Three times, they had me on the phone for about an hour because their computers wouldn't load the ITIN database. Did I mention that the hotline was only open from 8 to 5 which is kind of inconvenient for 99% of taxpayers because, you know, THEY WORK. At most jobs, people really can't wait on the phone for a personal call for an hour. And when my husband called from home to check on the ITIN, they told him that they couldnt give him information even though the number was FOR HIM. The fourth time I called, someone miraculously was able to get into the database within two minutes and gave me the number by phone.

Anyhow, I finally receive both of my refunds in July. There was an ordeal with the state tax department "misplacing" the ITIN form I sent them, but that's a story for another time. The funny part out of all of this is that the ITIN arrived by mail two weeks ago. Gee, thanks for the letter even though it's FIVE months too late. Monkeys in fezzes, I tell you.

Correct, the immigrant only needs an ITIN if he or she does not have an SSN. The ITIN is an Individual Taxpayer Identification Number, and it can ONLY be used for tax purposes. You cannot use it like a SSN, you can't open a bank account with it or get a driver's license with it, etc. :star:

Dave did come over on a K1 visa, I just meant that he wasn't able to work. That's why the Social Security office wouldn't issue him a SSN, although I told them over and over that it was alright. Since he didn't need one, we're just waiting. I'm just wondering about the 2007 tax year, not 2006. I was hoping it would be a nice little pay back, even though he hasn't been able to work and will only be able to work a very small portion of the year. Thanks everyone for giving your input!
