Hello,

 

I hope you are all doing well. I’m the petitioner filing for my spouse (the beneficiary) and have reached the NVC stage, where I need to upload financial documents, including Form I-864.

In Part 5 – Sponsor’s Household Size, the form asks:
“If you have sponsored any other persons on Form I-864 or Form I-864EZ who are now lawful permanent residents and you are still obligated to support, enter the number here. (NOTE: Enter ‘0’ if you already counted these persons in Item Number 1.)”

 

I have a couple of questions related to this:
1. What does “obligated to support” mean in this context?
I joint-sponsored two applicants in the past 2–3 years. Should I count them here, or not? They are financially in a good position and do not require my assistance anymore. They are not yet US Citizens.

 

2. My income is around $130,000 annually (based in NJ,USA).
One friend I joint sponsored his wife and he listed 3 children; the other friend, only sponsored his wife.
Will my income (according to the NVC) be sufficient to sponsor my spouse on my own, or will I need a joint sponsor?


Please advise when most convenient, your guys's assistance is truly appreciated!

1.  Yes.  You are still obligated under the I-864s until they become citizens, gain 40 quarters of work credit, leave the US and lose their status, or they die.

2.  Your income sounds sufficient, but check the I-864P for total household size..

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Correct.  Essentially, they are counted until they become citizens.  The question is about obligation, not the immigrant's needs.

Facts are cheap...knowing how to use them is precious...

Just so I understand this correctly, according to HHS Poverty Guidelines for the state of New Jersey, 125% of HHS Poverty Guidelines for a household size of 4 (which is in my case), is equal to $40,187.00 - this means I would have to make this much in income annually to be considered under this, correct? Which means my income of 130k, is more than enough? 

 

Just would like to clarify once more!

Yes, your income is close to triple what you need to qualify.
