I am writing this query in behalf of my aunt who petitioned her married son last 2016 and now a divorce. 

Her question is, how can she change the status of the petition from F3(married son/daughter of USC) to F1(unmarried son/daughter of USC)?

 Her case is pending at USCIS California Service Center. She mailed her son dvorcee decree, receipt number, and explaining letter 3 times over pass 2 yrs, but still waiting a response from USCIS?

Are there anyway can she do to speed up the case?

Yes she can

 

PD has to be current, you can’t speed that up

What's the Priority Date? When you say her case is pending, does that mean the I-130 hasn't been approved yet, or is it approved and waiting to be transferred to NVC?

PD 05/20/2016, I-130 has not been approved yet for F3, but for F1 it is approved. if they allowed to upgrade, her case should be approved.

What do you mean ‘for F1 it’s been approved’? Has the I-130 been approved?

Family-Based First Preference (F1) for unmarried sons and daughters of U.S. citizen. the visa was current few years ago if her case upgraded to F1 from F3 (married son/daughter)

Sorry but that’s still not telling us if the petition (I-130) has been approved or not?

OK, thanks for confirming. How has she contacted USCIS and provided the divorce cert? Has she got an online account, or did she mail it? If she mailed it, did it go to the office processing her case?

 

What does her case status say?

She mailed 3 times to service center that is holding the case but no responses starting 2023. Just create an online account and uploaded the divorce cert and sent a secure message but online portal does not have a space for you to explain the circumstance. It has a menu for you to check for the appropriate inquiry. So I checked "did not receive a response/make a decision". Then I received a response the case is processing within time.
