I-864 (Affidavit of Support) I have a question about my joint sponsor.

So my primary sponsor which is my spouse annual income is 31k: we send employment letter and a 6 paystubs. In 2024 - she didn’t work - we send an affidavit with explanations why she didn’t In 23 and 22 she made around 35/36k

she add her brother as a household member to increase her current income (was that a good decision?) His current income 48/50k annually we sent his last 6 paystubs His 23 and 22 - only 14k of total income

Our documents were qualified but we received a note asking for another sponsor.

So by this point I will be grateful if you can look at the whole picture 🙏

My joint sponsor annual income: 47k - we would upload her w2, 6 paystubs, employment letter In 2024 - she made 37.5k In 23 and 22 she made smaller amounts so we would only put her 24 tax - she’s been employed for this company for apox. 1,5 years so the employment letter is going to prove her stable employment.

I know I know! In the best case scenario it would be advisable to put her 3 past tax transcripts but as I previously mentioned ⬆️ she didn’t make enough in 23,22 - Xeniainternational said to not put these years if it was not enough.

My question is if they are going to combatin tax of my joint sponsor with main sponsor + household member in 2024 = 51.75 for all 4 of us which adds up to 51k or perhaps they are going to count it separately just me and the joint sponsor = 37.5k for 2 🙏

I might have an appointment within 4-5 weeks so I appreciate all help and answers 🙏🙏🙏🙏

No, imho. If she really needed a joint sponsor, the brother should have completed an I-864 as an independent joint sponsor, not as a household member (since his income is sufficient alone).  An independent joint sponsor (I-864) is better than a household member completing an I-864A, imo.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Current income is king....not what was reported in past years.  Why get a joint sponsor or household member at all?

That is a standard note from NVC when taxes appear low...which is meaningless.  The Consulate Officer is the sole authority for visas.   The last thing you want is to confuse the consulate officer.  That is why a single, well-qualified joint sponsor is better than throwing family members in the mix. To answer your question:

A joint sponsor's income and qualifications must be (and are) considered separately as an independent sponsor.

OK because I read somewhere that joint sponsor is only used to fill out the short fall in a primary sponsor form. I don’t know if it’s true but that’s what I read.

 

so if you look at the numbers, would you tell me if we will be fine and safe with everything adding this joint sponsor?

That is inaccurate.  A Joint Sponsor has exactly the same income requirements and obligations a primary sponsor.   Both the primary sponsor and joint sponsor are independently and equally obligated.

Numbers look OK to me....but I am not the consulate officer.

Thank you so much! Do you know if one we are approved by NVC we can erase her brother from my spouse i864 by for example bringing her new i864 at the interview? and explaining that we would erase him from her application or should we leave it like that? 
 

do you know if we should get W2 from IRS or the one sent by employer ?
