Hi All,

I am divorced paying child support for my daughter as wage garnishments. I have uploaded my pay stubs and state agency's portal details that I am paying child support regularly while filing for N400 online application. I have a couple of questions -

  • Should I also attach the court order now using the unsolicited evidence link?
  • For good moral character, has anyone uploaded any affidavit from neighbors or friends/family? If yes, is there a template someone could share that worked?

Thread is shifted from the US Citizenship Case Progress subforum to the main USC forum.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Unless others here say it's unnecessary, I think that you can.  It shouldn't hurt anything.

Unless something in your background indicates otherwise, I've not heard that these are necessary.

If you want, obtain one (don't go overboard) from someone of authority -- a minister is one example.

It should say how/how long/how well he's known you and affirm that you're a decent guy.

The affiant should include his contact information.

Avoid overthinking things and worrying too much.

You're applying under the 5-year provision?

Thank you, I will upload the court order as part of the unsolicited upload section. I agree, doesn't hurt

I am applying under 5 year rule. No Tickets of any kind, no misconduct, no arrest, paid taxes on time, paying child support on time.

For GMC, Yes I think I am overthinking as there are so many videos coming up on Instagram

One question though - In my child support order I have arrears of $6k as the judge backdated the order by a few months. However, as per the court order I should pay $100/ month to keep covering up for the arrears which I have been doing. So while there are arrears, the court hasn't directed me to pay the entire amount (even on the second court hearing which we did as I had lost my job a few months ago but got another one later one so a new court order was issues). What are your thoughts on this?

Hi All,

One question - I have recently filed N400 application online.

In my child support order I have arrears of $6k as the judge backdated the order by a few months as the other party had filed 6 months ago and the court dates were pretty backlogged. As per the court order I should pay $100/ month to keep covering up for the arrears along with paying the monthly amount - I have been doing both.

I recently had a second court date as I had lost my job a few months ago but got another one later one so a new court order was issued. So while there are arrears, the court hasn't directed me to pay the entire amount (even on the second court hearing).

Should I be worried about these arrears? What are your thoughts on this?

Hmm... I have no experience and will defer to others, but I think now that perhaps you should not upload this order (or anything else not required in the N-400 instructions).  Instead, bring it all to your naturalization interview along with evidence that you've faithfully complied by paying.

We'll see if others here concur.

Part 9   17g is the important question here

It will matter what the original divorce settlement was and what amount u were to pay in child support \

AS u stated , u are $6 K behind and your wages have been garnished

https://www.uscis.gov/sites/default/files/document/forms/n-400instr.pdf

In the instructions for N 400 on page 22 it says:

Been ordered to pay a fine, make restitution, or have your wages garnished.

1. Documentation of the order to pay a fine, restitution, or garnish wages; and 2. Documentation that you have paid the required sum or evidence of current payment

I uploaded my pay stubs to show wage garnishments as well as I uploaded the child support portal payment received screenshots as well. I believe that covers what is needed in Page 22. Correct me if I am wrong.

Additionally I have uploaded the court order as well which mentions that I have to pay $100/ month for the arrears.

I am just not sure if they decline citizenship if you have arrears on child support but still making all the payments as part of the court order. Thoughts?

to pay $6 K at $100 a month will take 5 years (60 months)

per your post  the judge backdated the order by a few months as the other party had filed 6 months ago and the court dates were pretty backlogged.    So , u accumulated 6 k arrears in just 6 months?

Not sure how the officer will view all this / just answer honestly all questions
