Hello Everyone! I filed for a K-1 Visa (I-129F Form)and received the NOA1 back in March. At the time of filing I had been working for the same company for over 17 years. Since filing, my employment at said company has ended. When I found out my job was ending I decided to take a break from working and go stay with my Fiancee in the Philippines. I have some money in savings and currently selling a home back in the US. My question is.... does the $26,000 plus income requirement have to be money coming in? Is there a certain amount needed in savings if you do not have a steady income?

Thanks for the help. Just trying to get ahead of the game.

Use the I 864P as a guideline, I had thought Manilla was not that bothered but there was someone on here who had an issue recently.

 

The bigger issue is adjustment, may want to consider Marriage and switching?

 

Joint Sponsor is another option.

Thank you for the reply. I've breifly reviewed the I-864P information. So far I cannot find anything referring to amount in savings but I'll review more in detail later.

From what I read the income information is requested at the interview, correct? I also read that the last tax return filed would be sufficient. Is this correct?

For income or assets? Big issue is you have no current income?

I'm talking about the income. I have tax returns for the past 17 years showing I made well above the required amount. 

If a person had two or three times the required amount ($50K to $75K) in a bank account wouldn't that suffice? Another individual can have a job/income of $55,000 a year and lose that job within two months after the K-1 approval. Thanks again for the conversation.

Only current income matters for affidavit of support, whether we like it or not...

Asset seems to draw more scrutiny lately, be prepared to show ample liquid assets. Current income is king, they don't care how long you worked before so currently you either need to show ample assets and be prepared for some haggling, (it seems some have had issues recently with asset only) or current employment showing adequate income. Wording here is key, you must show 3x the difference between income and requirements. So if you make 16k a year you have to show assets of at least 30k, 10k shortfall x3. However, visa issuance is at the sole discretion of the consular officer. I would advise to show much more than the 3x so it becomes harder to question it. The public charge issue is a big one for the current administration. You mentioned selling your house in the US (You cannot use this as an asset until it is sold), if this is your only residence then it will bring up another issue of domicile. You will need to show where you plan to live in the US once the visa is approved.

So did I, well to be precise to self sponsor, one of the reasons it is good to fill out your details.

 

Now adjusting was interesting and I assume mine was a sort of one off as by then my Sponsor had gone back to Uni, and the Officer decided to ignore that.
