So I am petitioning for my wife. My documents are currently at NVC and this is the message that I recently received

 

The income reported as stated on form I-864, I-864A is insufficient to overcome the public charge grounds of inadmissibility for visa issuance. To avoid delays, an additional Affidavit of Support Form I-864 from a joint sponsor may be submitted. For more information visit https://nvc.state.gov/aos and https://www.uscis.gov/i-864p. A consular officer will decide if you meet these requirements at the time of the interview. Note: You, as the sponsor, and any other sponsors household members and joint sponsors, must provide updated or additional evidence for the applicant to present at the time of their interview such as: * Other income * Assets * Proof of current employment Note: You submitted documentation to the National Visa Center through the Consular Electronic Application Center CEAC. You can continue to upload documents to CEAC up until the date of your visa interview.

 

I used my VA disability that I’m currently on and I receive 100% total and permanent so I am sort of lost on why they said my income was insufficient. Does this message imply that we will still get the interview for my wife but a counselor will determine if it’s good enough or are they saying until I get a joint sponsor that the interview would not be granted?

Yes.  If you can document that your VA pension is sufficient, you will probably be fine.  You can get your VA awards letter on the Ebenefits site.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

OK.  That is a very common notice from NVC. I wouldn't worry about it.  You could find a joint sponsor if you want.

Yes, she will get an interview once the case is document qualified and after her case has reached the front of the line at NVC (for her consulate). She should get instructions as what to bring.  But yes, your VA awards letter would be the evidence for current annual income to support the I-864 you submitted to NVC

I believe you will get a notice that the case is documentarily qualified.

I don’t think I will get the a notice that the case is documentarily qualified yet because they also said something about her birth certificate so until she gets the correct one they’re requesting I may not get that documentarily email anyway right? Both the sponsor and applicant must have all the required documents to receive this email?

 

 

also I think just because on the I-864 I didn’t make enough but I do have the Va disability do you think that’s why I received that response?

If your VA disability income is clearly sufficient, this notice about you income can simply be ignored, if the income is sufficient.  You got the notice based on your tax return or no tax return, because you income is not taxable.  The income issue will not prevent you being DQ, but you'll need to deal with the birth certificate issue to move forward.  Do you have that sorted out.

Facts are cheap...knowing how to use them is precious...

They just notified me of the problem today so my wife is going to get the updated required birth certificate tomorrow and I will upload it. I was just a little concerned because on the I-864 I did not meet the requirements. But everything has been approved on my side, but the only thing that’s missing is the birth certificate that was requested today so afterwards I should get the DQ correct?

You got a stock notice everybody whose latest tax return doesn't show qualifying income.  Just ignore it and carry on.

You will get a letter notifying you of DQ.  I had to reload a document for them that could not be opened, so it seems like we are in the same place.  From what I understand, after you replace the documents, they will review them again and send the letter.  I rescanned and uploaded my document on Wednesday, so I expect to hear something soon.  Make sure you click the "Submit" button again after loading all new documents.
