Hi,

My now husband and I are filing for AOS from K1 and after reading a few threads in here about the “applicant voluntarily completed vaccinations” box on the back of the form. 
my husband had a few vaccinations he was required to get before completing the medical exam. He got those vaccines and received the form. This box is NOT CHECKED. What does this mean? Is this an error of the doc?

File the AOS with what you have and include a copy of the DS3025.  Worst case, an RFE is issued to complete the DS3025, but that will most likely require a new complete medical exam by a civil surgeon.

This is your best option at this point. And RFE for the vaccinations is easily remedied.

I hear you. But I just don’t understand why? If he got all the vaccines needed. why would the box be left unchecked?

Human error... it happens. I've seen several reports here where they failed to give the patient the DS-3025 altogether

This is why I would submit it today as is.  The IO may look at it and see all the vaccines are completed, and ignore the unchecked box, you can bring it up at the interview if asked, or worst case, you get an RFE.  The point is don't delay an I485 package filing for this.

It looks good except for the missing TDAP vaccine.  It's weird he had the DT vaccine intead of TDAP.   This  means he is missing the Pertussi vaccine. The potential problem I see is that there is no blanket waiver for TDAP or Perrtussi.   You might get an RFE to submit a waiver or to get the TDAP vaccine.  Maybe you can go back and ask them if they forgot to record the TDAP vaccine or to give you waiver.

For comparison, my Wife's DS-3025 only had the TDAP and MMR vaccine by the panel physician.  Plus the covid record.  Everything else had the blanket waiver for everything else ... 

 

As far as I know, Pertussi is a required vaccine for the green card, and it is part of the TDAP which your form has totally blank including the waiver.

 

Maybe someone else might have more info about this ...

I reached out to the doctor who issues the report. He wrote back to me telling me to check off the box on the back (not joking). I have a screenshot of the conversation. Should I do this and provide a screenshot of the conversation?

After revising once more, he said to mark off the top box “ immigrant visa or parolee applicant completed required vaccinations”. Not the k-1 box…

Bad idea. You don't want to be accused of fraud and document forgery.

 

I'd just do a proper I-693 exam with all boxes checked by a civil surgeon in the US.

 

Does it cost extra money? Yes.

Does it make your journey much easier and keeps you out of trouble? Yes.

I thought it was ill-advised as well. Problem is #1 I didnt see this until completing out AOS package and we sre already out of status. In my opinion, it would be better to file now, include documentation showing they told me to check the box off, but NOT check the box and potentially get an RFE. At least at that point we will have an I-797 and can prove he is here legally..
