Pls I have a question.  My friend submitted a lease agreement that was edited by his friend who subleased a room to him in his apartment when he was filling N-400 the first time. So the  leasing agreement he submitted did not tally with the one in the leasing office because his friend added him and his ex wife to the lease manually.  After he filed the n400, his application was denied based on lack of moral character.  So he has waited for 5 years after the incident to apply again.  Do you have any advice for him when he wants to go for his interview? 

Also we want to know if the ISo would refer to the lease agreement issues that did not tally during his first citizenship application.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

How did he answer the following question in new application? 

 

"Have you EVER given any U.S. Government officials any information or documentation that was false, fraudulent, or misleading?"

 

In the last 5 years, did he done anything good for community? Or anything that shows good moral character.

Hello, thanks for your response. For the first question: he said Yes. 

 

And in the last 5 years he has done some community service around his community.

This great! I'm not a lawyer (and he may need to consult with one), but this looks promising. Unless he had other issues, I think this case might be approvable.

It's legal to sublease an apartment and very common to do so in large cities and that would not lead to a denial for moral behavior issue

 

I suggest your friend add this site and tell the VJ community about the interview and exactly what the officer said as moral character issue would need to be addressed

The issue was most likely the lease agreement was "edited" as OP stated. E.g. fradulent doc provided to officer.

Hi JeannAdil, he said the officer emphasized that the Lease he submitted did not tally with the one with the apartment mgt. I.e,  after his friend subleased the apartment to him,  he only manually added him and his exwife to the lease without going through the apartment management.

@OldUser thank you so much for your response,  he said he doesn't have other issues.  He's just wondering if the iO will probe him about his former marriage that ended over  6 years ago.

Hello VJ community. I have come with an update  on my friend's case. He went for his interview  with a lawyer recently but they said he has to be rescheduled because they don't have all his files.  He said they said he has two A-files. I wanted to ask... IS  it possible  for an individual to have 2 A-files... he's confused about that. Also,  pls has anyone had a similar experience where they said there are A-files.

I guess it's possible if he created multiple identities and USCIS thought they were different people? E.g. if he provided different name, DOB, nationality, place of birth for different cases. Not sure why else somebody would have two A files and how common this is.

 

Your friend should really join VJ. It seems like you care more about his case than he does.

I'll tell him to join...😁. No he doesn't have 2 identities that's why he's wondering what they mean by having another Afile. I think i made a mistake by saying 2 A-files. He said the officer said they need to order for his other A-file.
