Do you have good income? Or did you use joint sponsor? Or assets?

All of my income is W2 based and into 6 figures, so no joint sponsor or assets needed. I appreciate the insight! Would just hate to get denied for responding with the “wrong” form. The boilerplate RFE is so frustrating, I have NO idea where it went wrong!

List everything you submitted for I-864 and we'll be able to identify issue

Passport biographic page, tax return transcripts(last 3 years), W2s also last three years, employment verification letter. Thinking of including 6 months of pay stubs and 1040s for last three years also?

Not needed BECAUSE you submitted Transcripts. Only needed IF you submitted an ACTUAL tax RETURN.

Should have included 6 months of current paystubs originally to accompany the EVL IF you used your EVL income as current income.

Nope. You already submitted transcripts. 

 

Your RFE is likely due to incorrect amounts in the boxes.

If you input tax reported income as current income instead of EVL income as current income they would have sent you an RFE for providing useless info

 

Ensure you've read the I864 instructions through. 

Less is more.

Amounts must match

Too many proofs proving nothing because those amounts aren't listed on your form and you'll get an RFE for "what exactly is this applicant trying to show us?"

 

No to the EZ.

This may be the issue.  Is the RFE requesting copies of tax returns?  As @K1visaHopeful stated, W2's are not necessary when submitting IRS tax transcripts.  There have been examples of people receiving RFEs when they combine transcripts and W2's which does not make sense, but apparently USCIS can be easily confused.

 

If what I laid out is accurate, I would respond to the RFE by providing what they ask for rather than potentially creating more confusion by moving to an I864EZ.

It does make sense merely because it specifically says not to in the instructions. 

RFEs for not following them are petty but extremely common. 

 

Likely the RFE is for unmatching amounts between form and document and irrelevant documents submitted.

that’s helpful and completely my fault, In my mind, all of the numbers needed documentation, so the EVL was for my current income as it is not the same as last year’s. The RFE asks for returns and supporting documents in the form of W2s, so I’ll lean toward 1040s with those W2s but I’m working on just getting in with an immigration attorney because at this point I’m clearly out of my depth.

You need to do whatever you feel you need to do related to an attorney.  This is a fairly common RFE as most people do not realize that the W2 information is already included in the IRS transcripts, so I assume an attorney will tell you the same thing wrt responding to the RFE.

 

If it were me, I would send in everything the RFE asked for even if some of the information is duplicated such as sending in additional copies of your W2's with the corresponding 1040's (don't assume common sense with USCIS).
