Here is an earlier post explaining her situation:

"Hey all. I am getting extremely nervous. My interview is next week!!! For those of you not familiar with me or my case:

In november of 2004 I was given an expediated removal for lack of documentation while coming from Canada to the US. I had been living with my hubby in the states from April of 2003 until I was removed in November of 2004. I was married to my husband (USC) in July of 2003 and we have a daughter born in the U.S in May of 2004. The lack of documentation was pertaining to our marriage (we hadn't filed anything). We have a lawyer who has worked on the case, but can't come to the interview. My husband is going to attend with me. It is in Montreal.

I was given a 5 year bar."

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

This explains why the I-212 & I-601

did your lawyer prepare you for this?

did you have hardship letters and supporting documents prepared and were they filed with the waivers??

If so your waivers will be sent to the Vermont Service Center...you will recieve a recipt notice from Vermont for both of the waivers and new case #'s for each waiver....once you have the new case #'s you can track them on the USCIS case status.

There is a group of Canadians and others on www.immigrate2US.net

in the I-601 forum who also have filed waivers and their time-lines for the waivers are also posted there

I dont believe her lawyer had her filing out the 601 at first, but Zygyy came to her rescue!!

Hi. Yes, we had the I-212 and I-601 with hardship letter filled out (Thanks zyggy!!!). So, we filed them while we were there. I have no idea if this will help our chances...any thoughts would be greatly appreciated! Thanks everyone!

It's my pleasure to be of help... Best of luck to you in your processing of the waivers... They'll be processed at the VSC, so look to their timelines to get a feel for how long it will take..
