I came to the states under A-1 diplomatic visa with my father as principal applicant. Overstayed my visa, and eventually had DACA. Married a USC this year and we applied for AOS earlier this year.

 

Submitted & received approvals on following

  • I-130/I-130A (Petition for Alien Relative)

  • I-864 (Affidavit of Support)

  • I-765 (Application for Employment Authorization)

  • I-131 (Application for Travel Document)

So far so good - received a combo card too.

 

 

Submitted and received request for evidence for:

  • I-485 (Application to Register Permanent Residence or Adjust Status)

  •  

RFE: Submit Forms I-508 and I-566. USCIS records indicate that you last entered the United States as a(n) A, E or G International Organization officer, employee, or immediate family member nonimmigrant. Any applicant who was admitted to the United States in an A, E or G nonimmigrant classification, and who has not changed that classification to another nonimmigrant classification, is required to complete, sign and submit Form I-508, Request for Waiver of Certain Rights, Privileges, Exemptions and Immunities; and Form I-566, Interagency Record of Request -- A, G or NATO Dependent Employment Authorization or Change/Adjustment to/from A, G or NATO Status. It appears that you are subject to this requirement.

 

I-508:seems fairly straight forward. 9. does ask for Employment Information (name and address of employer) - filled out my father's (then) employer. and in additional information elaborated 'THIS ADDRESS IS WHERE MY FATHER, P/A: FATHER: NAME WAS EMPLOYED AT THE TIME OF OUR ARRIVAL. I DID NOT WORK THERE'

I-566 is a little bit less clear. for 3.a I selected 'Change of Nonimmigrant Status from A' & 3.b. 'LAWFUL PERMANENT RESIDENT' - or would/should it be something else in 3.b? or possibly 3.a should be 'Adjustment of Status from A to Immigrant'?

On 3.a. pick the fourth option "Adjustment of status from A, G, or NATO Nonimmigrant to Immigrant" because that's what you're doing. 3.b. leave blank or put in "N/A" as this question is applicable only for the first two options.

 

First one is for when you move from some other non-immigrant status (e.g. F-1 student) to A/G/NATO.

Second one is for when you move from A/G/NATO to some other non-immigrant status (e.g. into F-1 student).

Third one is for when you give up permanent residence in US to instead take up diplomatic status (e.g. green card to A-1).

Fourth one is for when you move from A/G/NATO to green card. (which is what you're doing).

Fifth is Section 13, where you are applying for permanent residence in US because it's unsafe for you to return to the home country.
