Hi everyone! I have seen a couple different things when I searched for this section. I am looking for clarification. Question 53.- Does this mean our initial meeting in person or just seeing each other in GENERAL the two years prior? 

What all can I use as physical evidence?

I have pictures of us together. Can I use movie ticket stubs? text messages?

It does not refer to only the initial meeting, though for some the initial meeting falls within the 2-year requirement. You need to have met with your fiance, in-person, within the last two years from the time USCIS receives your petition. 

 

Dated evidence with printed names is the strongest. Boarding passes, a copy of the beneficiary's I-94, and airline receipts are all good examples of this. If you happen to have passport stamps you could include those as well, though I know a lot of countries do not do that. It doesn't hurt to include photos and movie tickets, but photos are not time-stamped and movie tickets do not have individuals' names printed on them. Text threads are good evidence for a bonafide relationship, but they would not prove visiting in person within the 2-year requirement. 

 

My fiance and I submitted all of our flight receipts, all of our boarding passes, I-94 copies, and his ESTA where he listed me as his contact in the US/where he would be staying.

@ScarletWitch6x Thank you for the reply! I really don't know what we could use as proof of visits for the last 3 years because it has been travel across border by land so there are no flight tickets or passport stamps.

The only thing really if they allow it is let's say I screenshot our photos on our phone with the information for that photo. I will attach an example.

Aside from that there is nothing. Would family/friends written statements count for proof?

The metadata on photos can be adjusted. 

 

Did the foreign spouse cross into the US? Even though it was not entry by flight, there should still be an I-94 record of the crossing. Any joint trips that included hotel stays? You could use those receipts as well. 

 

I submitted pages of photos - so I would say yes still include them. I don't have any personal experience with sworn statements at this stage, but maybe someone else will have some recommendations :)

CBSA has this info: https://www.cbsa-asfc.gc.ca/agency-agence/reports-rapports/pia-efvp/atip-aiprp/thr-rav-eng.html

 

"As of July 11, 2019, the CBSA collects exit information on all travellers (including Canadian and American citizens) in the land mode and in the commercial air mode as of June 25, 2020. Exit data may also be requested through the Travel History Report."

 

"If you have checked the When not to request your Travel History Report section and still need to request a copy, you can apply online by following the instructions on the Access to Information and Privacy online request page. Note that it may take up to 30 days to process your request."

 

Sounds like something you should explore, in the absence of an I-94.

I would recommend trying to find any and all dated proof you can send. You could also try explaining the circumstances around your meetings in your intent to marry letter. In our letters we expanded upon the visits we shared and how they happened.

This is great advice and me and mine did the same. We used the circumstances letter to just provide more context around the timings of our plans and why we did what we did. For OP, they might mention driving as it was easier/more cost effective, which explains the absence of other travel evidence.

In my experience, it can be hit and miss if it's all recorded (I find the same with passport stamps too). I have travelled to the US before even knowing my fiancé and my I-94 doesn't show all entries and exits. I also didn't get a passport stamp on entry last November but did this March. 🤷‍♂️

I have a couple questions about this section.

My fiance (petitioner) a very long time ago was charged for "Child Endangerment" specifically that - no jail time, no restraining orders but did 2 years probation.

 

Question

2.a. Would I answer yes to this question or no because it does not specifically list child endangerment? But it does have Child Abuse & Child Neglect listed and not sure if it would count within that.
