Hi Everyone,

I submitted my i751 application with divorce waiver about 2.5 years ago as I was divorced at the time. 
I am getting re-married (to a different person) and would like to change my last name. 
 

How do I do this?

Has this affected anyone in the past?

If you get an interview, I suppose you can let them know during the interview. 

 

I also applied with divorce waiver and I submitted the I751 with my maiden name (instead of my previous married name).

 

But if your interview is waived and you get the new green card in hand, you can apply I90 to change your last name to your new name.

Timeline:

Biometrics Taken - 11/24/2021

Ready for Interview - 5/16/2023

How do I do this?

It's hard to pull this off because there's no official process once I-751 is pending. You can write a letter to USCIS asking for it. The chances are, you'd be ready to naturalize and you won't have GC in the new name at that time. Things take forever at USCIS. Add a thing such as name change in the middle of the process and it can take eternity. From purely immigration process standpoint, it's the worst time to change the name while I-751 is pending. If you manage to make it work, let us know. Good luck!

Hi! I applied for I-751 under my married name and received extension letter under married name. However, I am now divorced and I have court order (gold seal) with my new name I am adapting. I am planning to get my Passport, SSN, DL updated to my new name as per court order. I also plan to travel to my country during year end, will this cause an issue as my passport would have my new name and I-751 extension letter will show my old name(married name). My immigration attorney advised to carry the court order along with me displaying my old and new names for immigration purpose. Is that enough? 

2 - Also, how would this name change impact my pending I-751 application process? I expect to receive RFE as I my divorce was not finalized at time of filing, I couldn't submit my divorce decree as a proof under divorce waiver. Can I have my documents submitted to USCIS when I receive RFE?

I'm not as qualified as an immigration attorney. Sounds like a good advice. Though you'd have to convince airline staff in other countries, this is the hardest part.
