It is Wednesday, and here is our Semiofficial Semiweekly VAWA-Thread Joke:

THE TRUTH IN LIFE

 

My electricity bill came today, and I think that I got charged for the sunlight, moonlight, street light, the light of the Holy Spirit, and the light at the end of the tunnel.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

U.S. Customs and Border Protection (CBP) has the legal authority to send anyone, including U.S. green card holders, to secondary inspection when entering the United States.

Reason why we were all astonished at the level they were systematically sending Green card holder for second inspection.

It's actually not uncommon; dozens of my clients have been sent to secondary inspection, and it even happened to me three times when I was a green card holder.

It has happened to me as a USC.  It doesn't need to be for obvious reason; it can be for other agents' training purposes, internal quotas, or arbitrarily for every 16th entrant on foot, every out-of-state license plate with a "W" in it, etc.

THE PRIEST AND THE POLICE OFFICER

 

An Irish priest was driving home from a night at his favorite bar.

 

A police officer noticed the priest's car swerving all over the road and pursued it.  The Irishman pulled over, and the cop walked up.

 

Checking the vehicle and noticing bottles all over the floorboard, the policeman asked, "Have you been drinking?"

 

"I don't know what you're talking about, officer," said the priest.  "I've just now left church after giving praise to the Lord for his many blessings and miracles."

 

The policeman frowned.  "Well then, what's in the bottles?"

 

"Water," the priest replied.

 

The policeman reached in, grabbed a bottle, opened the top, and was quickly overcame by the smell.  "This is wine!"

 

The priest then promptly shouted, "PRAISE THE LORD, HE'S DONE IT AGAIN!"

Master hearings are generally very brief. If you have a lawyer your lawyer will be doing 99% of the talking. 

Other than that the way it'll basically just look like:

If it's the first one:

Do you admit or deny the allegations in the NTA? 

What language do you speak?

What is the designated country of removal? 

 

If it's any then it's basically just taking attendance and the status of your case. 

E.g.

Did you show up? Good. 

Is the I-360 still pending? Yes: Reschedule for another one. No: Either grant a motion to terminate or schedule you for an individual hearing. (Similar vein with EOIR-42B where if it's still backlogged - reschedule, if it's current - individual hearing, COR can only be granted by an IJ). 

 

That's about it, master hearings are for the most part just procedural.

Hello, an inquiry was sent by Congressman as regards update on VAWA case filed August 2022 with 4 Prima Facie. Understood another PF was sent but is there more meaning to this. The response was “ U.S. Citizenship and Immigration Services (USCIS) records indicate your constituent's Form I-360 is currently under review.
 
Please advise your constituent that even though the petition is still under the review process and could be denied, your constituent has demonstrated a substantial likelihood of being a victim of abuse. USCIS has determined through the review process that your constituent met the minimum requirements for approval of the I-360 petition. Thus, USCIS granted an extension of Prima Facie Determination (PFD) with a notice sent (G-28 Attorney) on August 29, 2025. The PFD is valid for a period of 180 days from the notice date.”

This is just my pure assumption coming from experiencing situations faced. This appears to be a standard template of response. But good news is since it being 43 months as a standard time to process 80% of VAWA cases on their website you are very close and most probably they are reviewing your case and is close to finish line with a positive news. Because if something was found or a reason to deny they would have escalated and done so by now. I believe it does go through multiple hierarchy of approvals so it will take time. But seems to be in the right direction. If you are August filer then 6-7 more months for a decision.
