I do have one question: I had 7 months unlawful presence before I filed my original application. But my I-360 and I-485 are still pending (and I have I-765 & I-131 approved for 5 years, about to expire in 2029). I am aware of the current situation in the country. If ICE encounters me, can they still detain me even if my I-360 & I-485 are pending but because I had 8 months unlawful presence before filing the application?

Keep a copy of your receipt. Your case is still pending, and there is no cause for concern.

In New York City, it typically takes at least 12 months to schedule an interview, but in Brooklyn  it could take up to 18 months. If you need to update your address, send a certified letter and also call USCIS to request the change. Ask to speak with a Tier 2 officer for assistance. While ICE can  make arrests at USCIS offices, it’s uncommon. As long as you don’t have a criminal record or a final order of removal, you should be fine.

That's why many immigrants under C08 (Asylum working permit) have a lot of difficulties while returning from any travel abroad.

But with C09 category, things are somewhat different.

I’m hoping to get some clarity on whether it’s better to file for a divorce or seek a declaration of nullity in the case of a bigamous marriage.

 

Backstory: I found out in 2020 that my marriage was bigamous. Since then, I have filed for VAWA and despite some delays, I finally got my green card last year. I’m now at the point where I want to fully separate myself from this individual and am trying to decide which legal route makes more sense, especially with naturalization in mind.

 

Every time I’ve traveled outside the U.S. and returned, I’ve been sent to secondary inspection. The questions almost always revolve around whether I’m still in contact with my ex. During one of my most recent trips, the actually advised me to get a divorce so I could fully cut ties.

 

 @Sandra G. made a comment on a similar post that bigamous marriages can create complications when applying for citizenship. That really got me thinking, and now I’m unsure what the best legal step is in my case.

 

I’d be grateful for any advice or experiences anyone is willing to share. Thank you so much!

My former client was granted a green card through VAWA two years ago. Upon reentering the U.S. after an international trip, he was questioned extensively about his VAWA case and spent over an hour explaining the details to the officer(secondary inspection). He's already the third individual this year that I know of who has gone through this. Now imagine if you don’t even have a green card. I advised all my clients not to travel until they received their green cards.

 If you have a pending I-485 (Application to Adjust Status), you are considered to be in a period of authorized stay by USCIS, even if you had prior unlawful presence.

SO TRUE and confusing!

This past week (July 2nd),I was coming from a trip abroad. I noticed that our queue, exclusively green Card holders were having hard times with immigration officers. They were systematically sending almost every Green card holder to second inspection until I wanted to change the queue.

Unfortunately, I couldn't do it because I was the next to follow.

For the first time, I was asked a lot of questions like:

Where are you coming from?

Why where you in that country?

How many countries did you visit?

Are you currently working?

I was shocked and very surprised because, those on the visitor queue were not having these level of screening 😕. Their queue were going very fast until we were asking hour self what is going on with green Card holders.

It was like they HATED green Card holders.

Because that officer couldn't send me to the second inspection, he succeeded to lock my passport and green Card in a small plastic box, handed it to me and asked me to go to the baggages control so that they can check All my bags.

After checking All my bags, those officers were even astonished and were asking me WHY the other officer even sent me to THEM...?

It's becoming very frightening.....
