Hi there, 

 

He is convicted for drug trafficking 10 years ago.

Do you mean that he just need to submit the 1-129F first before the K1 Visa application?

Does this form takes time to process before hitting that stage where we need to submit documents such as letter of consent for my son etc?

Yes, much later.

 

The petition will take up to 15 months to process, possibly more with a felony background.   The USC needs to be the one to submit the petition.

 

Also, hopefully you realize that you can visit on the VWP (subject to CBP), but you can’t just come and live in the U.S. during the process.

There is a show on American TV right now called "Prison Brides" women from different countries come to the US and marry their US citizen husband. 

It is not illegal and you will most likely have to organize things before you arrive to get married in prison. 

You might want to look online for groups of foreign women who are dating men in prison for more guidance on the process.
