My spouse has the chance to get a residence permit in a 3rd country, but we want to keep the original embassy for interview location. Potential problems?

Hello, we have NOA2 and are DQ'd, and waiting for interview letter. my spouse has the chance to get a residence permit in the 3rd country where we stay together with visa-free travel.

Getting this permit would make it a lot easier for her to apply for the Schengen visa she needs to go to her CR1 interview location. However, I'm worried that getting this new permit might violate some policy (by getting a residence permit during an immigration process, or it might affect how her legal address is considered, requiring us to change interview locations).

We don't want to change interview locations because this 3rd country is supposed to be quite slow.

I was thinking she could just get it keep it until the interview is done, cancel it, and move on. It won't be in her passport.

I couldn't find any guidelines either way online. Any guidance is appreciated.

To my knowledge this will not impact the interview location unless you actually requested the change of consulates.  She will have to disclose the additional residency when she fills out the DS160 or at the interview and if she is there for more than six months, I believe she will need a police report from that third country.

Good Luck!

I don’t think she fills out DS160…I think that’s K1. she already filled out DS260. she also already submitted a police certificate for this country because she’s been there visa free for so long.

we would be required to disclose this at the interview?

You are right, I meant to say DS260, and yes, if her residency changed since the DS260 was filled out, she should disclose it.
