Previous marriage in the Philippines, both now U.S. Citizens - can I remarry in the Philippines?

Hey all,

 

Unfortunately, my marriage has come to an end after a 16 year relationship. Not my choice.

 

When we married in the Philippines, I was the U.S. citizen, now we both are.

 

I have met a Filipina who I would like to marry. My question is, what would I need to do to marry her there, as I have marriage recorded in the Philippines?

 

Any information would be greatly appreciated. Thanks is advance.

You were married in the PH so you will be considered legally married there until you get a recognition of divorce from the PH government. This takes lots of money and 1-2 years. You are better off filing for a fiance visa.

How sure are you about this? What about the Utah online marriage? With fiance visa, would there be issues with CFO stemming from this situation?

 

I ask if you are sure, because the purpose of the process you mention above is to allow Filipinos to remarry in instances of a foreigner and the Filipino divorcing. I am not a Filipino....

In order for you to get married in Philippines, the LGUs are more often requiring a CENOMAR from both party to get a marriage license.  You will not be able to provide this because you still have a registred marriage.

So what's the way out of this? This cannot be a unique situation. Utah online marriage? Fiancee visa? Anyone have solid information?

The only thing closed is a marriage in Philippines unless you are willing to get your foreign divorce recognized.  Marriage anywhere else in the world or fiancee are available.

If we were to marry using the Utah method, would there be any issues in terms of CFO or anything on the Philippines end? I'm trying to find a way for us to marry rather than doing the fiancee route if possible. Thanks. Edit: as in, because of previous marriage, i couldn't get a ROM recognition of marriage for NSO?

In the 17 years i have been a member of this site, i honestly cannot remember a time where CFO was denied.  A few have been found it a bit more challenging but ultimately have received the "sticker" in the end by having to comply with a bit of additional beauracratic BS.

NSO doesn't exist anymore. 

 

If anyone should have gotten hassled by CFO, my wife should have been one.  This is my third marriage, my second with a k visa and a 35+ year age difference.  She went into the seminar confident and came out an hour or so later smiling.

About my statement? I am positive. Utah is an option if you want the get a CR1. I don't know of anyone that has tried that yet.

Doesn't matter it you are Filipino. Get a CENOMAR (in your case it would be a CEMAR) and you will see that you are legally married in PH.

 

In all cases your biggest challenge will be CFO. But like @IWander said she would most likely get it, she would just have to beg, plead, and jump through hoops.

You will never get a ROM for your new marriage until you get a recognition of divorce.  It is PSA now not NSO

The Utah marriage is all you need for US immigration.  So long as your divorce is recognized by the US it does not matter what the Philippines says.   No problem getting the visa with a Utah marriage certificate.  CFO would give you an extra ration of difficulty but would eventually let them still pass.

A Utah marriage and a post ceremony visit to the Philippines to fulfill the consummation requirement.

Can also do the Utah route while in the PH taking care of both at once
