AOS/K3(request for initail evidence)

I'm self-employed, No employees, I work alone. Last Month, I filed AOS for my wife who is here on K3 Visa.

Today, I received a pink Request for Initial Evidence (I-485) asking me to submit the following in 87 days:

W-2s, 1099s, and/or all schedules submitted to the IRS. A copy of his/her federal income tax return was submitted and/or the sponsor or joint sponsor requested an extension to file his or her federal income tax return.

Like I said, I'm self employed, work alone & requested an extension to file my last year tax return.

really need to know what do I have to do now?

Maybe they need the papers that say that you requested/were granted the extension? Did you include the W-2s and everything?

September 2004 - Ede comes to the US as a foreign exchange student

05-17-2005 - Our first date

06-28-2005 - Ede goes back to Hungary

12-28-2005 - Ede comes back to the US! (F-1)

12-10-2006 - We're Engaged!! :D

EAD

04-20-2007 - Ede applies for EAD

06-29-2007 - RFE for EAD (Grr...)

08-10-2007 - Work Permit Received! Finally done! :)

AOS

06-28-2007 - Civil marriage

06-29-2007 - Appt. #1 for med. exam (blood draw & TB skin test)

07-01-2007 - TB skin test was POSITIVE due to the BCG vaccine...grr...Chest x-ray done

07-06-2007 - Went back to civ. surg. w/ TB clearance...not good enough. Can't have the physical yet.

07-13-2007 - Chest x-ray being checked out by TB doc...still no exam.

07-13-2007 - AOS packet ready to mail...except for I-693.

07-24-2007 - Still no exam, but at least they let us set up the appt...

07-27-2007 - Med. Exam DONE! Overnight-mailed AOS application to Chicago!! :D

07-28-2007 - USCIS signed for delivery of package

08-24-2007 - NOA1 Date1, although it was rejected. See next line.

09-04-2007 - AOS Rejected - improper fee, even though it was postmarked before the 30th

09-05-2007 - Sent back entire package with new cover letter explaining improper rejection

09-23-2007 - AOS package rejected again! E-mailed Congressman

10-05-2007 - Went to Congressman's office - left packet there so be re-sent

10-19-2007 - NOA1 Received -FINALLY! Not rejected! :D

11-02-2007 - Biometrics appointment at Waukegan Office

02-05-2008 - Interview in Chicago -approved! :D

What evidence did you send in with your I-864?

Sounds like you'll need to file your taxes...

2007-04-16: I-485 and I-765 sent to Chicago (My AOS/EAD checklist)

2007-04-17: Received at Chicago

2007-04-23: NOA1 date (both)

2007-05-10: Biometrics appointment (both - Biometrics review)

2007-06-05: AOS interview letter date

2007-06-13: AOS interview letter received in mail

2007-07-03: EAD card production ordered

2007-07-07: EAD card received! (yay!)

2007-08-23: AOS interview (Documents / Interview review)

2007-08-23: Green card production ordered!!!

2007-08-24: Welcome notice mailed!

2007-08-27: Green card production ordered again... ?

2007-08-28: Welcome notice received!

2007-09-01: Green card received!

Done with USCIS until May 23, 2009!

I have heard of people getting RFE's for not sending in the W-2s, so I would send them in for sure. Do you have any documents about your extension? Maybe those would also be helpful. Better to give them too much info than not enough, I guess! :)

since I'm self employed, how can I have W2 for myself, right?

& form 1099 is for U.S. independent contractor that has received payments in the calendar year that total $600 or more for services (including parts and materials) & i don't fall in this catagory.

I'll have to ask my accountent for proof of filing ext.

Bad planning on your part with a AOS pending.

Sounds like you need proof of income such as 1099s plus either fill out your tax 2006 forms and get them in or get a joint sponsor.

Most extensions are only good until sometimes this month anyway unless you get an extension for the extension!

Since your self employed and just work alone, and dont receive 1099's from an independant contractor then yes you get a joint sponsor, he or she will also have to fill in form I-864 and submit his or her 2006 tax return with W2's , giving as much evidence of his or her current salary, copies of pay stubs for the past 6 months, letter from current employer etc.....instructions are on the I-864 as to what evidence to include.

I hope i've given you the right information. My hubby is also self employed and this also what we did.

If the joint sponsor is also self employed.......

exeed the 125% poverty line for 2007.... http://www.uscis.gov/files/form/I-864P.pdf

Read the instructions on form I-864 carefully

Fill in form I-864 .......... submit copy of most recent Federal Income Tax return...photocopy of Form 1099 that relates to your return. pay stub(s) from the most recent six months.

OPTIONAL

Your joint sponsor can submit copies of his/her most recent 3 years Federal Income tax Returns and copies of all 1099's that relates to the returns.

Its better to send them more than they're asking for.

Simple answer!

Just have joint sponsor or you do so "if" you filled and get tax transcripts from IRS and submit them.

They are positive proof you or sponsor filed and how much you made.

No need W2s if employed by someone else or 1099s if self employed.

I'm self employed and that worked for me.

I know where I made that stupid mistake. Under the filing Instruaction of I-864, It says you must get your 1040 copy from IRS, if not then you must submit W2's & 1099...thats the mistake I made, I didn't call IRS to send me transcript of my 1040. I submited my own copy.

I'll call IRS & request them to mail me 1040 copy.

One more thing. I'm above poverty line on my 1040, do I still need joint sponsor?
