Recent move, when to file? (split)

Hi  Everyone,

 

Coming to this forum after a year. I have a quick question on N400 filing as I am sure you all are in the same stage of the application process. So I recently moved to a new state and I am confused about when should I file my N400 and what documents should I submit to show that I have been in the new state for at least 3 months, so here are some facts:

 

So my permanent residency anniversary for 3 years rule is on November 6th, 2023  so I can file 90 days early so which means I can file N400 as early as August 8th, 2023.

 

However, since I moved to a new state from Texas on 25 May 2023 so adding 3 months to the date would be August 25th, 2023. Therefore, I am planning to file after 25th August 2023.

 

1. Does this date look good, Am I calculating it correctly? or Am I missing anything?

2. What documents do I need to submit on my N400 to prove that it has been 3 months since my residency in the new state?

I don't recall a requirement to submit anything to prove that on an N-400.  You just list your places of residence and dates of residence.  I have asked the friendly mods to move this to the proper forum.

@Crazy Cat I was wondering how would USCIS know that I moved to a new state on the 25th of May without presenting a document proof. I am not sure if I even need to show them any evidence of moving to a new state. As far as I understand that if one moves before filing N400 then the individual has to wait for 3 months before filing N400 in that state. What documents do I need to present to prove that it has been 3 months in that state or do I even need any documentation proof? Any enlightenment would be good. Thank you!

First of all, did you file AR-11? Did your US citizen spouse file I-865? That would be first proof.

 

Since you're applying under 3 year rule, your proof of bonafide marriage will indicate when you moved:

- Joint lease will have the start date on it

- House deed documentation will have date on it

- Utility bills will have dates on them

- Bank statements will have dates on them.

 

On all of the docs above, you'll have both dates and addresses which will allow USCIS to establish when you moved. They can also send people to ask property manager if you have a lease etc etc.
