My spouse and I submitted I-130 and I-485 concurrently. We have the AoS interview to be precise Feb 7th 2022. The interview went smoothly as expected. We were informed to get a feedback within 120 days. Its over a year now and still waiting. Just few days ago, my spouse ( the petitioner)  got a notice for the I-130 interview. So I'm quite confused. The impression I had was  that the AOS interview convered for both scenarios since we submitted docs together. Has anyone had such an experience of being invited for I-130 interview after an AOS interview....?

I-130 interviews are rare. It indicates problems with the case.

Has petitioner filed  other I-130s before?

Petitioner has filed 1-130 in her previous failed  marriage but got a divorce decree

Well there you go.

1. Did that beneficiary get a GC?

2. Was petitioner born in U.S.?

Petitioner should have an immigration attorney present at the I-130 interview.

It has likely been referred to the fraud unit.  Like Mike said, time to lawyer up.

Please update us on the outcome or any new infos. We filed in April and My spouse was previously married and filed for ex spouse back in the days. Wondering if that always causes problems? Did they ask you at your aos interview about previous marriage ? Did the previous Spouse get approved back then? How long ago was the previous filing? Please share details so others in similar situation can have those info’s. Thank you and good luck!
