Tax Transcript for I134

Hi everyone, feeling a little overwhelmed at the moment. 

We are aware that for the Affidavit of Support, the petitioner and/or co-sponsor needs to provide the recent year’s IRS tax transcript. 
 

1. I’m curious…the 1040 has exactly the same information, it just doesn’t say “IRS TAX TRANSCRIPT.” Does the 1040 also work, or must it specifically be directly from the IRS?

 

2. I am currently working with DoorDash in between my gigs in my industry, and they don’t provide any kind of letter as you are considered self employed but not an employee. If I simply provide my 1099-NEC tax form from them for last year, would that suffice in place of the Letter of Employment?

1.  The user-generated complete 1040 tax return package is acceptable. 

2.  Self-employment documentation evidence includes 1099s, schedule C from previous year, etc.

I very recently helped a friend complete an I864 for NVC in the same position. (DoorDash driver)  While I realized they are self employed, I was still rather surprised how poorly DoorDash documents drivers payments.  I figured there would at least be some sort of regular statements. Apparently not.  In the case of my friend, he submitted last years 1040 with all schedules, forms and 1099's included in the filing.  There was no transcript available and his previous years transcripts were no help.  Then for current income he literally submitted screen captures from his phone of weekly pay and tips.  We had considered bank statements but his bank statements were kind of a mess for unrelated reasons so we figure the screen captures were the most easily understood evidence he could come up with.  We included all that along with the letter below and that passed muster with NVC .  That was an I864 for a spousal visa rather than an I134 but I assume the requirements are similar.

My current employment status that of an independent contractor and as such 100% of my 2023 income is reported to the IRS on Forms 1099-NEC.  My 2022 tax return was E-filed with the IRS on March, XX 2023 however, a return transcript is not yet available so I have included my complete, filed 2022 IRS Tax Return, along with each and every Schedule, and 1099-NEC that were included in the filing showing 2022 Total Income of $XX,XXX.

 

As an independent contractor I do not receive pay stubs but rather I receive income in the form of regular direct deposit payments from the companies I do work for.  While my 2022 income exceeding the HHS guideline is fully documented by my filed tax return and form 1099-NEC, to show that my ongoing and regular CURRENT INCOME in 2023 is consistent with or exceeding my 2022 income I have included the following additional documentation.

I calculated my current 2023 annual earnings using the following methodology.  In the first 8 weeks of 2023 I have received actual income in the amount of $X,XXX.XX.  I divided that amount by 8 to arrive at average weekly earnings, year to date, of $XXX.XX.   Extrapolating annual earnings from actual average weekly earnings, (~$XXX/wk X 52wks) I arrived at current 2023 annual total earnings of approximately $XX,XXX.

Based on my actual year-to-date earnings in 2023, my 2023 total income should easily exceed my documented 2022 total earnings.
