Please forgive me if this has already been asked but I need some clarification and I am not finding an answer. I a

m getting ready to file for AOS for my wife who came in on a K1 visa, and want o get it done before the new fees on 7/30/2007. Do I need to file an I-864 or an I-134 again with the 485 paperwork. I was under the impression that USCIS already had the I-134 submitted during the K1 visa interview.

You need to file an I-864. :)

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

Timeline

I-134 is for NON-Immigrant visas and is used at the consulates only.

I-864 is for the GREEN-CARD, and is used at the consulates for Immigrant visas, and also for AOS in the USA.

So you use I-864, or I-864EZ for AOS. Look at the I-864EZ it is easier to understand and fill out, hence the "EZ", the EZ form is for cases where you are a solo sponsor, using no assets, and are sponsoring 1 immigrant, we used it.

You'll need another affidavit of support, yes, this time the I-864. This one is a binding contract, as opposed to the I-134. Read the guides, it's there. :thumbs:

Hi Mario...

You'll have to file a new affidavit of support! This time it's the I-864. They are called the same but are different forms. I just sent my papers away last week cause we wanted to have them filed before the 07/30/2007 too. I sent my work permit directly to the Vermont office and the I-485 to Chicago (it has to be send to Chicago) and now, just a week later they already sent me a notice that they started processing my file. You can send the papers away together in one letter or the work permit to the service center for your location, California, Nebrasca, Texas or Vermont. I did it this way because the processing times in Vermont are shorter than if I would send it to the main office and I want to go to work as soon as possible.

NOT Good advise, if you read the directions included with I-765 you will see that there are specific places to file for EAD.

If your response to question 16 is:(a )(6 ), (a )(11 ), (a )(13 ), (a )(17 ), (a )(18 ), (c )(2 ), (c )(3 )(i ),(c )(3 )(ii ), (c )(3 )(iii ), (c )(5 ), (c )(6 ), (c )(8 ),(c )(17 )(i ), (c )(17 )(ii )or (c )(17 )(iii ):

mail your application based on your address to the appropriate Service Center. The correct Service Center is based on the state or territory in which you live.

If your response to Question 16 is (a )(9 ), mail your application to:

USCIS

P.O. Box 7218

Chicago, IL 60680-7218

If your response to question 16 is (c )(9 ), file your application at the same local USCIS office or Service Center where you submitted your adjustment of status application. (Chicago)

(a )(6 ) is the only one that goes to VSC/CSC/TSC or NSC, this is for K-1 filing for EAD BEFORE filing AOS, and will result in a USELESS EAD card with expiration date the same as the K-1's I-94 card.

(a )(9 ) is for K-3 visa holders, and like K-1 the expiration is tied to the I-94, but in K-3 cases that can be a good thing K-3's get an I-94 with expiration date 2 years from entry. (Chicago)

(c )(9 ) is for filing with AOS and after filing for AOS "I-485 pending" and is filed at the location that the I-485 was sent to (Chicago)

I-864 does not, and has no place for a Notary to sign and stamp the form.

Completing the Affidavit of Support forms

Are the Affidavit of Support forms required to be notarized?

No. The sponsor just has to sign the form. You should know however, when the sponsor signs an Affidavit of Support form, he/she certifies that the information provided, transcript and/or photocopy of tax documentation is true and correct, under penalty of perjury.
