Hi, new here. Nice to see the forum.

 

My wife has been in the US for two years now on a K1 and we filed for AOS Dec 24, 2001. We went to civil surgeon and did everything requested and now today I get an RFE that we used the wrong form I-693. Well, the form was valid when we submitted it. The civil surgeon asked for her covid card but she does not have one (already had covid as did I am my child) and it was not required when we filed. She does not want to get one because of her religious beliefs. I won't even get into all the stats flowing around about it.

 

Anyhow, since she has been here for a while and it took them a year and a half to get around to it, what has everyone else done? It seems like they are completely moving the goal posts everytime we turn around.

USCIS has full discretion to ask for a new medical. I have seen it happen here more than I can count and applicants just get a new medical. If you do not want to get the vaccine, you can file for a Waiver. You can try to argue that you do not need to undergo a new medical, however I don’t know if that will be successful and you risk the I-485 being denied.
