i864 rejected and i864W requested for my 2.5 yo child

Hi all - I filed for my son who is 30 months old and they just rejected my i864 form and asked for the i864W instead in the name of my son.

 

Can anyone help in the below:

  1.  Should I fill the i864W as my son and not as myself like I did for i864? Because all fields are for the requestor so I am bit lost...
  2. Should I delete the rejected file from the CEAC account? I.e. the i864 I had submitted.
  3. Where do I upload the i864W filled form? It is in the name of my child, but maybe should be under the Affidavit of Support and Financial documents under my name, no? If so I delete the old one from the required documents and upload this instead? Or just add it under the additional documents section?
  4. Should I be uploading any statement on why we filled the i864w? I read some places in the forum that some people added a summary or a letter to the form, please help?
  5. Will the NVC treat this addition like I just submitted the case as in bring us back into last in the queue? Or is it possible to get an answer after a few days if all documents are good to go?

Also, as I am filling the i864w, part 3 is not clear for me:

  1. Do I check 1.a. "I can read and understand English, and I have read and understand every question and instruction on this request and my answer to every questions" or do I check #2."At my request the preparer named in Part 5 XXXX prepared this request for me based only upon information I provided or authorized."
  2. If I check number 2, then I have to fill part 5 which is the Preparer section. As a parent of a minor (child 2.5yo) am I considered or a preparer or I just sign my name in part 3 and write (mother) next to the signature? 
  3. If only 1.a. do I sign my name or my son's name in part 3 6.a.?

I tried to find the right answers but didn't get any direct ones here in VJ.

From what I see from your earlier posts your son will become a USC upon entry into the US, so it appears the I864W is the correct form.

 

The intending immigrant is a child who will become a U.S. citizen upon entry under INA section 320. Under INA section 320, some children become U.S. citizens immediately upon admission to the United States or adjustment of status to that of a lawful permanent resident (LPR).

 

I would fill out the I864W in the name of your son, and you would be the preparer and fill out that appropriate section.

Yes correct, i-864W is the one requested now.

In many places it seems I need to choose 1.a. and not #2, hence my confusion on why not to submit as a preparer and in the forum, there are a lot of contradicting answers... In the form instructions it only says that as a minor, the parent is the one that "should" be filling and signing the form, so it makes sense to have that, but should we fill 1.a. or 2. under part 3, this is my concern now.

After reviewing the form again, I would say 1.a. would be the proper choice as even if you are filling it out as your son, you are the parent of a minor and are allowed to act on their behalf and sign the form on their behalf.  So ignore the Preparer section and just fill it out and sign it as if you were your son.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
