process for new born in Canada ( father american, mom canadian) to get legalized in US?

Hi,

 

sorry if it is in wrong topic. We are currently pending spousal visa for me and my son to move to US to join my husband. However, now I am also expecting our mutual child with my husband, I live in Canada and our child will be born in Canada, can anyone refer me to what is the process to get the child legalized in US so all three of us can move smoothly once our visas are ready? I read about it a year ago but forgot what the name of visa is/or whatever this process is named. I remember it sounded relatively easy for newborn though whose father is American.

Timeline

On the assumption of being a USC you need to file a CRBA and then a US Passport.

  1. How much physical presence does he have in the U.S. (= days actually spent in the U.S.)?
  2. How much of that past age 14? 
  3. Is there proof of his physical presence?

If I remember correctly, if 1. is >= 5*365 days, and 2. is >= than 2*365, and the answer to 3. is yes: your child is a U.S. citizen, and you should look at your embassy/consulate’s website and search for CRBA and file for that once the child is born. 11/08/2021 appointment at USPS (2.00pm)

11/16/2021 money order cashed, passport “in process” (locator 69)

12/02/2021 approved and shipped

12/04/2021 passport book delivered

12/13/2021 passport card and NC delivered
