This question is related to vawa.

My girlfriend suffered abused from here husband hence she file vawa April 2021. She hasn’t received any work permit bcuz her lawyer put c31 however she recently found out about it and refiled in September 2022 still no word as yet. She has gotten 3 prima facie and no RFE thus far. 
She’s overwhelmed and been waiting for the longest time any advise I could share with her please?

Very sorry about your girlfriend.

Based on what I read on this forum, it's not uncommon to wait 3-4 years to get decision on green card case based on WAVA.

 

Also, the work cards take 8-10 months for married people (straightforward cases). So she may not see a work card for another 6 months easily.

Was an adjustment of status filed with the i360?

 

If not, then no work card until the i360 is approved which takes 3 years. She needs to file an adjustment of status packet i485, i765, and i131.

 

If an adjustment of status was filed, which it sounds like it was, and a new i-765 application with category code of 09 was filed so they will get a work card in 4 to 6 months or so. A work card can take 6 to 10 months to be issued.
