Has any one tried to get a Tourist Visa for the spouse why after the Open there I-130 and if so was it approved or not and what reason for not. I know this is hard to do and government have a lot of issue with it but i have read that there is no law against doing this. Please le me know.

there is no law for doing so, everyone is free to apply.

Not enough strong ties to the home country such as a stable career; immigrant intent shown (which would be seen due to a pending I-130 so it’s hard to overcome that).
 

If you have $160 to spare, you can apply but I would have low expectations to avoid disappointment.
