Help!!!!! Please read and reply!

Hi everyone, I am in desperate need of help!!!! My brother married his high school sweetheart about 4 years ago, he petitioned for his green card papers. He had his first interview probably about 3 years ago. The interview went good, but his fingerprints were not updated, therefor, the officer couldnt make a desicion on the case, so they put it on hold. A while after that, his wife and him were having problems, they decided to live apart for a little while until things got better, during this time, his wife had an affair with another man, and she became pregnant!!! This resulted in a big feud, they finally seperated for good, not legally or anything. She had the baby about a year ago, and he finally got news from immigration telling him that he has a second interview soon. They havent lived together in like two years, and they dont have any joint ank accounts or anything. What should he do in the interview??? Is he pretty much doomed? Can he claim her infedelity as spousal abuse? Please help me!!!!!!!!! He can definitly prove that they were high school sweethearts, but hes worried because they no longer live together!!!! Any comments will be appreciated!!! Thank you!

There are a lot of blanks, but infidelity is not abuse, although it can leave one broken hearted. Although you didn't fill out how he got here in the first place. I don't think it will matter. It sounds like getting PR status for him is dependent on marriage. If thats the case its likely he doesn't have any choice but to go back to his home country.

Have him get an immigration lawyer. GOOD one!! Like real good!
