US citizens abroad get an automatic 2-month tax return deadline extension (June 15) and there's no need to even file for an extension.

Am I reasonable to assume that we might get someone at NVC that isn't familiar with this and would RFE us for sending 2020 as the latest? And that we should send in a letter and upload under 2021 latest?

 

Please, no comments on why the USC should just file now / should've already. Everyone's tax situation is different and there's a thing called tax prepayment.

I would expect NVC will ask for 2021 taxes right now.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thanks for sharing your perspective! While the paragraph makes it sound like the intention was for active duty members it is not -- the USC abroad has been filing for a number of years past April, and there is no doubt about whether the June deadline is or isn't correct for expat taxes. I understand the viewpoint in this forum about discouraging filing an extension around NVC stage but I feel this is not the same as we're not actually filing an extension.

 

Please jump in if anyone else has first hand experience, but I will share our experience for posterity once our docs get reviewed (just hit NVC stage).

There's always a chance you'll get somebody reviewing your case who is unfamiliar with the automatic extension.  If you do, there will be a delay.  It's your decision whether to risk this possible delay based on your own priorities.  Nothing to do but decide, then live with the result.

Facts are cheap...knowing how to use them is precious...

I would write an explanation about why you haven't filed 2021 taxes yet and share the screenshot of the rule.

Upload taxes from 2020, 2019, 2018 to show you've filed the last 3 years. 

Then upload taxes in June, 2022 while you wait to be DQ'ed. 

 

Or wait to submit the I-864 and supporting documents until after you've filed taxes.
