How soon can you file?

Hi everyone,

My temporary GC expires November 16th... so the 90 day window before the expiration date would start around Augut 16th... can we file before the end of July?? Do they really reject the packet??

I believe so. On of the first things they do is check for eligibility. If you file more than 90 days in advance, you're not eligible and your petition should be rejected on those grounds.

Yes it will be rejected...... I am in the same situation.... our window opens on Aug 13th so we just miss out on the lower fees too.... nothing to do but pay the new fee....

My spouse's conditional GC expires on 10/29/2007. If my calculations are correct, the 90-day window begins on 7/31/07. This is one day after the fee increase.

Would it be wise to try to beat this fee increase by mailing out the I-751 on Friday, July 27 using 2-day priority mail? If this is the case, VSC would not receive the petition until at least 7/31/07, but the leter shold be postmarked on July 27. since this is so close to the fee increase, I would like to try to beat the fee increase date of July 30.

I do not know any I-751 case that has been rejected for filing earlier, but I know about somebody who filed the N-400 one week earlier and they sent it back. Good luck !

they'll probably check the postmark vs. the date you are first allowed to submit your petition, I don't think you're going to be able to not pay the increase in the fees.
