on page 1 part 1 it says you must complete this portion as the petitioner if you are filing this petition on behalf of another person.

 

i am filing this for myself and my family as derivatives, so do i leave this portion blank or still fill it out?

 

also, on page 3, part 4, it says if person is outside the US, is ineligible to adjust status in the US or does not wish to adjust status in the US, provide information about the consulate at which person prefers to apply for an immigrant visa.

 

Do i leave this part blank or select the consulate he will go to for interview? as person is overseas in Afghanistan but plans to adjust status when they come to US. God Willing

SIV is an immigrant visa, and u will not adjust status in US

wait what do you mean i will not adjust status in US, dont i receive a visa pending approval and interview then come to the US and adjust status for green card or is the green card automaitcally given?

 

please clarify

SIV is immigrant visa

u will apply for green card when in the US a year

SIV applicants in the United States file the form I-485 to ask to receive lawful permanent resident status. This is also called green card status.4 days ago

 

the I 130 form is also used by K1 holders to adjust status in the US/  in this case ,  u will interview in your country not interview here

sorry,  i did not explain it clearly but u will not actually AOS after a K1 visa

your process to green card is slightly different

embassy

u are not in the US to interview here as a K1 person would do for AOS after marrying a USC

the form is for both (sorry it is confusing and USCIS should use 2 different forms )
