Mom in US, Father and Brother in Korea

Hi everyone.  

 

Quick background - Wife was a Korean citizen who went through the process and has now been a USC since April last year.  Her adult brother and father are in Korea and her mother is  a Korean citizen here in the US on a visitor visa.

 

I have a few different questions.

 

1. We are trying to fill out the I-130 and I-485 for her mother but since they now charge for the I-131 and I-765, I am wondering if it is worth it with the current processing timelines.  I know with my wife, she received her greencard before her I-131 and I-765 were approved.

 

2. For her father, we would fill out I-130 and is there anything else?  Then he just waits for a date at the Korean consulate? Sorry I have never done this.  How do we find out how long this process takes?

 

3. For her brother, I know that her petitioning would get last priority.  So would it make more sense for her to wait until her mother receives the greencard and then have her petition as that becomes a priority 2 instead of a 4?  Or should we just petition now and wait it out?

 

4. Finally around fees.  Since things have changed since I did it for my wife and there really aren't any savings for submitting packets with applications together ( that I am aware of ), is it correct that it would be: $1,710 if I find that the I-131 and I-765 is not worth it? And $2850 if I submit all 4 like I did in the past correct?

Good insurance for her to petition her brother as well as her Parents. You never know.

Thanks for answering.  EAD and AP, I read that they were not included anymore when you file the I-485

As for her brother, I only worry about with siblings, sometimes they can take 10-15 years.

More than 15 years but he would need to remain single being sponsored by LPR parents, at least until Citizenship. And even that route will not be quick.

Does the mother want to stay in the US while she waits for EAD and AP or does she want to return to Korea and wait out the process? 

Your wife's process was fairly quick but these days EAD and AP are taking 6-8 months and sometimes longer. 

Not sure how long it will take to get a GC from your field office.

We are currently going through Seoul and the first half of the process (Approval of I-130) takes anywhere between 3-12 months (sometimes longer) and it is not country specific. 

You'll then have to upload documents to NVC and currently the process takes 3 months (also not country specific)

Waiting time from DQ to Interview doesn't appear to be backlogged. 

 

Two IR5 cases I can find (on a Korean forum)

 

Filed IR5 in 2020 (didn't state when)

Transferred to NVC March 2021

Submit DS260 October 21st 

Interview Notification Mid December 2021 (Seoul usually sends out interview notices in the middle of the month)

Interview: Mid February 

(this person appears to have delayed the process at NVC stage)

 

Second Case

Filed:  December 2020

NOA2: March 4, 2021

Submitted documents to NVC: April 21, 2021 

DQed: May 27, 2021

Interview letter: June 13, 2021

Interview: July 16, 2021. 

 

It appears the waiting time between DQ and Interview is fairly short and matches IR1/CR1 dates. (about 2 months after DQ).

Yes. She will wait in the US going through Adjustment of Status. Originally the plan was for her to go back in January and wait in Korea but due to COVID and kids being at home, she missed her opportunity to go back last month.  She is 40 days overstayed now.

You can only go through Seoul. 

Busan doesn't handle immigrant visas. 

Believe it or not, Korea is one of the faster consulates. 

You could get lucky and have the I-130 approved in 3-4 months.  

Otherwise you're waiting just like the rest of us. 😅

Hi Chancy.

 

Yes I went there but there was no information about the waiver.  I saw for the 131 the waiver still exists but it does not say it for the I756 so I am glad that you let me know that they are both still waived.

 

I also am now confused about the biometrics as it used to be $85 but I thought it was dropped to $30.  I wish someone who recently submitted their docs were able to clarify for me.
