Dear members: I have a couple of questions to ask you. I think this the right forum to be in. I am a British national and have been living in the US for a couple of years. I am legal but my visa is expiring. I met the girl of my dreams about six months ago and there's been talk of marriage. I want to be with her and see two possible routes:

Going back to England (I'm in the US now) and applying for a fiance visa sounds like the most obvious way. How long is this route taking? I am sure there must be lots of Brits here who are going through the process, and it would be good to hear of your experiences. How long did it take, etc? This may sound dreadful and weak but I don't think either of us want a long distance relationship. My girlfriend is freaking out about having to spend long amounts of time apart.

The other option is applying for another work visa. The HB1 visa isn't an option and so i'm looking into an exchange visa, or a J1 visa. This isn't the place to discuss this, but i think i could find a US employer to sponsor me. If the K1 process seems like it would be too much (i can't picture us being apart for a long time) then this may be better.

Your experiences of the k1 process in London would be great. Any J1 experiences would be cool, too. Thanks!

Get married now and adjust status, and dont leave until you have your green card in your hand.

If you decide to go back and wait for a K-1, you are looking at 9-12 months before you wil have the visa in hand.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

You can get married and adjust without having to return to the UK.

However, if you want to be able to return to the UK within the timeframe of after your visa expires, before getting married or waiting for your green card, you will not be able to do so unless you have an Advance Parole (which you will only be able to apply for after marriage).

The K-1 takes about 6-12 months, as DF says.

You'll get all sorts of opinions here.

A quick consult with a competent immigration attorney, with full disclosure of your present immigration status, would probably be the best source of an opinion for your future course of action.

Would you like this to be moved to the UK forum?

Liz, do you think the question is relevant to only UK visa holders or anyone who might be here on a visa?

You should consider marriage and adjusting status, you can file for AP along with AOS, and use that for trip home. Much quicker than all the other visa options.

I don't think i can stay in the US and get married legally. I will check with a lawyer. This time frame for a K1 visa seems outrageous! Does it really take 6 months to get the visa? I can handle waiting for a greencard/work permit. I just don't think I could wait 6 months to be with my girl again. Can anyone say how long they waited for their k1? I've seen only a couple of London timelines.

Talk to a lawyer. You might like what you hear.

If you're here legally now and you didn't enter planning to immigrate, then you're probably in for some good news from a lawyer or from your own research.

7-06-07 Interview at 9:00 am at the London Embassy - Approved.

7-16-07 Visa delivered after 'security checks' completed

I-129F approved in 111 days; Interview 174 days from filing

Six months is also very quick! Most are averaging 7-8 months so the advice to speak to an immigration lawyer will be even more attractive I think. Believe you me having to wait this long is hard on both parties so if you can find a way to stay in the US, get married and adjust without coming back......... do it.

it sounds like you can marry and adjust status and avoid separation. of course, if there are other circumstances you haven't shared here, then my guess is a bad one. but if i were in your situation, i'd be a happy camper.
