Brother to bring wife and children to the US.

Timeline

Hello everyone I have a question about submitting  the I-130 petition. My brother got married in Mexico and has two children with my sister in law. They currently reside in Mexico while he is here working. My brother is a US resident. He is currently vacationing in Mexico and will be coming back soon. He would like to know what documents he is going to need to begin the process. And also if he needs to fill out 1 or multiple I-130 forms.

Timeline

You say he is a US resident. Do you mean he lives in the US so he is a resident or do you mean he is a Permanent Resident (green card holder)? If you brother is a USC or a Permanent resident the process is a bit different. Please let me know so I can make sure this thread is in the right forum?

Topic moved top LPR forum since Petitioner is a LPR.

I went ahead and moved to "Bringing Family Members of LPR to US".
@smelimick1 your brother would submit a I-130 and add the children as derivatives. He can't upgrade and become  US Citizen during the process otherwise he will have to submit I-130 for the children also.

It's going to take awhile. Expect 3 to 4 years at best.

Alright I will pass on the information to him. Thank you. What documents will he need for his children? Just the birth certificate? Or will they need other documents at the nvc stage?

your marriage certificate

Are they 16 or over they will need police report also.
