Hello guys, I am a US citizen and brought my wife on a cr1 visa.. She has been in US for almost 2 years now..We just noticed that her GC has expired and we were planning to go to canada for our summer vacation..Should we cancel our plans...any way to get a extension of some sort...please help :help:
Didn't you apply to remove conditions?

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Have you filed the I-751 for removing conditions? It should have been filed 90 days or less before the conditional green card expired. You should cancel your plans, and she should not leave the US until it is sorted.

US Immigration Timeline

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

These two statements are contradictory - if she's not yet in the USA for 2 years then her green card has not yet expired. Dates, please.

If her green card has expired, then her status as an LPR has expired with it. Submit an I-751 ASAP and include a good reason for not having filed when she should have.

You need to file for lifting of conditions and then wait for it to be logged into the system so that you can get an I-551 stamp. Without that stamp or extension letter, you could run into trouble. Possibly a fine.

How do you imagine you can continue on with your vacation plans if your wife has lost her LPR status? They of course would not let her back into the US with an expired GC! Common sense says cancel plans and file paperwork.

2009 - Conditions lifted

I think that thread was moved from this forum too... can't remember now. Anyway, I edited my response, as nobody did suggest seeing a lawyer in that thread, but still....!

2005 - We met

I would definitely not go to Canada without her new green card. My husband and I just returned from there after celebrating our second wedding anniversary. They let us right into Canada but on our return, they stopped us at the border and we had to go inside for them to be sure his green card was valid, which it was. We had no problem but they did check it so do not go. Good luck on getting your paperwork straightened out.
